He requested direction from the <br />Board regarding the proposed subdivisions and the reservation of a right-of-way <br />for the Western By-Pass in these developments. <br /> UPON MOTION of Chairman Nash, seconded by Commissioner Milloway and <br />unanimously carried, the Board referred Article IV, Section C of the <br />Cabarrus County Subdivision Ordinance to the Planning Board to be revised <br />as expeditiously as possible. The Board asked that the section be made more <br />definitive and suggested that a stipulation be placed in the Subdivision <br />Ordinance that Section C of Article IV would have no effect unless the area <br />involved was being actively considered by the State as a viable project and <br />a construction date or right-of-way acquisition date had been established by <br />the State. <br /> Mr. William Mills, III, attorney representing the property owners of the <br />proposed smaller subdivision, requested immediate action regarding the two <br />proposed subdivisions as he stated these subdivisions would be presented <br />to the Planning Board before the Subdivision Ordinance could be amended. <br />He asked that the Board make a determination that Article IV, Section C of <br />the Subdivision Ordinance is invalid because if applied as writte~ it <br />would require that the County condemn property for the purpose of highway <br />corridors. Mr. Mills asked that the~Board direct the Planning Board to <br />ignore that section of the Subdivision Ordinance until it is amended. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Chairman Nash and <br />unanimously carried, the Board instructed the Planning staff and Planning <br />Board that in the case of the Western By-Pass, as shown on the maps at <br />this time and nothing being permanent in the next nine years according to <br />information the Board now has, that Article IV, Section C of the Cabarrus <br />County Subdivision Ordinance not apply. <br /> The Board reviewed the letter received from Mr. A. V. Davis in response <br />to notification by Mr. Charlie B. Irvin, Building Inspector, that the wall <br />behind the Post Office is dangerous and that corrective action be taken <br />immediately. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Milloway <br /> and unanimously carried, the Board agreed for the County Attorney and <br /> Building Inspector to continue with condemnation proceedings against <br /> Mr. A. V. Davis in regards to the retaining wall located behind the Concord <br /> Post Office. <br /> Mr. Charles McGinnis, County Manager, reported that the engineering <br /> costs for investigation of the retaining wall behind the Post Office totaled <br /> $1,200.00 and would be paid with funds from the Board-directed Expenses <br /> budget item. <br /> There being no additional business to come before the Board, the <br /> meeting was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
