518 <br /> <br /> (2) When an approved sanitary sewer extension project has been <br />completed and the total cost thereof has been determined, seventy-five <br />percent of the total cost of such sanitary sewer extension shall be <br />assessed against the property owners whose property abuts upon such <br />extension at an equal rate per front foot in accordance with and under <br />the authority granted to the County by Article 9 of Chapter 153A of the <br />General Statutes of the State of North Carolina. The remaining <br />twenty-five percent of the total cost of such extensions shall be borne <br />by the County from funds appropriated for this purpose. <br /> (b) Extensions to Proposed Developments or Subdivisions. <br /> (1) When an application is received requesting the extension of <br />sanitary sewer service to proposed developments or subdivisions within <br />the corporate limits which have not been approved by the Board, the <br />County Manager or other person designated by the Board shall estimate the <br />cost of the project and present the application for such extension, the <br />estimated cost and other required information to the Board for their <br />approval. If the application is approved and subject to the approval of <br />the development or subdivision by the County, and subject to the <br />availability of funds, the County will install or have installed by <br />contract under its supervision such extensions which shall be financed <br />in accordance with paragraph XIII.b.(2). <br /> (2) Prior to the beginning of any construction, the owner or <br />owners shall deposit with the County funds in an amount equal to one <br />hundred percent of the total estimated cost of such extensions. Upon <br />receipt of such funds a written contract shall be entered into by and <br />between the County and the property owner or owners in accordance with <br />the requirements of this Ordinance. Such contract shall provide that <br />in the event the funds deposited exceed the amount of the total extension <br />cost when completed, then that portion in excess of the total cost will <br />be refunded to the owner or owners without interest. Such contract shall <br />also provide that if the amount deposited is less than than the total cost, <br />when completed, the owner or owners shall pay such additional amount to <br />the County. <br /> (3) In lieu of depositing funds the owner or owners may execute <br /> a surety bond guaranteeing payment for such extension or the owner or <br /> owners maY have such extension work performed under private contract with <br /> the approval of the Board, provided, the work is to be performed in <br /> accordance with all construction requirements of the County and subject <br /> to inspection and approval of the County. (c) Refunds. <br /> No refund or reimbursement of funds shall be made to the owner or <br /> owners who pay one hundred percent of the total cost of extension under <br /> the requirements of this subsection except as provided for in paragraph <br /> (b) above. <br /> (d) Facilities Excluded in determining Owner's Share of Cost. <br /> (1) When the County determines that it is advisable to install <br /> larger size facilities than are necessary to serve the property requesting <br /> such extension, the difference in the cost of the larger size facilities <br /> over and above the cost of the facilities required to serve the property <br /> requesting such extension shall be paid for by the County and excluded <br /> from the total cost to be shared by the property owner and the County <br /> as provided for herein. <br /> (2) Pumping stations, and other system facilities installed for <br /> general~public use which are expressly identified in the application or <br /> agreement approved by the Board shall be paid for by the County and <br /> excluded from the total cost to be shared by the property owner or owners <br /> as provided for herein. <br /> (c) Exceptions Authorized. <br /> Nothing in this Ordinance shall prevent the Board from extending <br /> sanitary sewer mains within the County on their own motion without <br /> receipt of an application from property owners, and to assess the cost of <br /> such extensions in accordance with subsection (a) of Section XIII of this <br /> Ordinance when, in the opinion of the Board, the general public interest <br /> demands such extension of service. <br /> <br /> Section XIV. Specifications, Ownership <br /> Any sanitary sewer mains extended under the provisions of this <br /> Ordinance shall be installed and constructed in accordance with the <br /> approved plans, specifications and other requirements of the County.
