510 <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne <br />and unanimously carried, the Board approved the following change to the <br />proposed Sewer Ordinance. <br /> <br />Page 18. Section XVI (d) (4) <br />In the case of discontinuance of service for any reason except <br />repairs or other necessary work by the Board, the customer shall <br />pay the Board for all past due service charges and all costs of <br />disconnecting and reconnecting service. <br /> <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Payne <br />and unanimously carried, the Board adopted the following Cabarrus County <br />Sewer Ordinance as corrected. <br /> <br /> CABARRUS COUNTY <br /> SEWER ORDINANCE <br /> March, 1984 <br /> An ordinance to regulate, restrict and limit, in the interest of the <br /> public health and safety, the deposit or discharge of certain substances <br /> into any sanitary sewer now maintained and/or owned by or which may <br /> become the property of or which may be leased to the County of Cabarrus, <br /> State of North Carolina. <br /> WHEREAS, the Federal Water Pollution Control Act Amendments of 1972, <br /> PL 92-500 (hereinafter referred to as the "Act") have resulted in an <br /> unprecedented program of cleaning up our Nation's waters; <br /> WHEREAS, the County of Cabarrus has already made and will continue <br /> to make a substantial financial investment in the regional wastewater <br /> treatment system to achieve the goals of the Act; and <br /> WHEREAS, the County of Cabarrus seeks to provide for the use of the <br /> regional wastewater treatment system by industries served by it without <br /> damage to the physical facilities, without impairment of their normal <br /> function of collecting, treating and discharging domestic wastewater, and <br /> without the discharge by the regional wastewater treatment system of <br /> pollutants which would violate the discharge allowed under its National <br /> Pollutant Discharge Elimination System (NPDES) permit and the applicable <br /> rules of all governmental authorities with jurisdiction over such discharges. <br /> BE IT ORDAINED AND ENACTED BY THE BOARD OF COMMISSIONERS OF THE <br /> COUNTY OF CABARRUS, STATE OF NORTH CAROLINA BY ADOPTING THE FOLLOWING: <br /> <br /> Section I - Definitions. <br /> Unless the context specifically indicates otherwise the following <br /> terms, as used in this Ordinance, shall have the meanings hereinafter <br /> designated: <br /> (a) "Biochemical Oxygen Demand" (BOD) means the quantity of oxygen <br />utilized in the biochemical oxidation of organic matter under standard <br />laboratory procedure in five (5) days at 20oC, expressed in terms of <br />weight and concentration (milligrams per liter). <br /> (b) "Board" is the Board of Commissioners of the County of Cabarrus, <br />North Carolina. <br /> (c) "City" means the City of Concord, North Carolina. <br /> (d) "COD" (Chemical Oxygen Demand) means the quantity of equivalent <br />oxygen utilized in the chemical oxidation or organic matter as measured <br />by standard laboratory methods, as set out herein, expressed in parts per <br />million. <br /> (e) "Color" shall mean the "true color" due to substances in solution <br />which may cause any variation in the hue of the receiving stream and is <br />expressed in parts per million. <br /> (f) "Commercial/Industrial User" means a user not meeting the <br />requirements of a "Residential User". <br /> (g) "Compatible pollutant" means BOD, suspended solids, pH and fecal <br />coliform bacteria, and such additional pollutants as are now or may be in <br />the future specified and controlled in the City's NPDES permit for the <br />regional wastewater treatment works where said works have been designed <br />and used to reduce or remove such pollutants. <br /> (h) "Cooling Water" means the water discharged from any u~ such as <br />air conditioning, cooling or refrigeration, during which~the only pollutant <br />added to the water is heat. <br /> (i) "Director" shall mean the Director of Utilities of the Board of <br />Light and Water Commissioners of the City of Concord, North Carolina. <br /> <br /> <br />
