533 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />April 2, 1984, at 9:30 A.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Archie Y. Barnhardt <br /> Marcelle Milloway <br /> J. Harold Nash <br /> Kenneth F. Payne <br /> The invocation was given by Reverend Randy McCall, Assistant Pastor <br />of Calvary Baptist Church of Kannapolis, North Carolina. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br />and unanimously carried, the minutes of March 21, 1984, were approved as <br />written. <br /> Chairman Lentz announced that members of the Board had been invited <br />for lunch at 12:00 noon at the Lutheran Family Services on Spring Street in <br />Concord. <br /> Dr. Robert C. Lorish, Area Director of the Piedmont Area Mental Health, <br />Mental Retardation and Substance Abuse Authority, reviewed the proposed <br />resolution to allow Area Authorities to own property under the provisions <br />of G. S. 122-35.53(c). He stated that the authority to own property would <br />basically apply to the ownership of group homes. Dr. Lorish recommended <br />that the Board of Commissioners add the stipulation that any property <br />acquired in Cabarrus County by the Authority would have to be approved by <br />the County Commissioners. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board deferred for further consideration the <br />proposed resolution granting consent for the Piedmont Area Mental Health, <br />Mental Retardation and Substance Abuse Authority to hold title to real <br />property and to acquire the same. <br /> Mr. William E. Fisher, owner of J & F Disposal Company, Inc., and <br />Mr. Hubert E. Hoglen, Jr., owner of Royal Garbage Service, were again <br />present regarding their request for a rate increase for garbage collection. <br />As the Board had rejected the establishment of a tipping fee for the <br />County Landfill at the meeting on March 21, 1984, Messrs. Fisher and <br /> Hoglen requested a $1.00 per month increase for regular operating expenses. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Nash <br /> with Commissioners Barnhardt, Nash, and Milloway and Chairman Lentz voting <br /> for and Commissioner Payne voting against, the Board moved to allow the <br /> franchised garbage collectors to increase rates by fifty cents (50¢) per <br /> month for residential refuse collection in Cabarrus County effective <br /> July 1, 1984. This constitutes a rate of $6.50 per month for roadside <br /> service and $7.50 per month for rear yard service. <br /> Mr. Thomas B. Robinson, Planning Director, reviewed the progress of <br /> the Planning staff in the elimination of duplicate street names in the <br /> county. He reported that the effort to secure voluntary agreement on <br /> road name changes from affected property owners had been unsuccessful. <br /> Mr. Robinson proposed that the Planning staff and Planning Board formulate <br /> a recommended policy establishing guidelines for street name changes for <br /> review and approval by the Board of Commissioners. He requested direction <br /> from the Board regarding the continuation of work to eliminate the duplicate <br /> street names or the removal of this project from the Planning Department's <br /> work list. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br /> unanimously carried, the Board directed that the Planning staff and Planning <br /> Board proceed with the work on street name changes and the development of <br /> guidelines for these street name changes. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br /> and unanimously carried, the Board approved the following Right of Way <br /> Agreement between Cabarrus County and the Board of Light and Water <br /> Commissioners. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />RIGHT OF WAY AGREEMENT <br /> <br /> THIS RIGHT OF WAY AGREEMENT, made and entered into this 2nd day <br />of April, 1984, by and between CABARRUS COUNTY, a governmental sub- <br />division of the State of North Carolina, party of the first part; and <br />THE BOARD OF LIGHT AND WATER COMMISSIONERS OF THE CITY OF CONCORD, a <br />governmental subdivision of the State of North Carolina, party of the <br />second part: <br /> <br /> <br />
