<br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M.
<br />on Thursday, May 3, 1984, in Courtroom 2 of the County Courthouse in Concord,
<br />North Carolina, for a public hearing regarding proposed Zoning Atlas and
<br />Text Amendments and Private Road Standards for Cabarrus County.

<br /> Kenneth F. Payne
<br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board,
<br />presented each of the proposed amendments as recommended by the Planning
<br />Board. Mr. James F. Owens, Assistant Planning Director, reviewed the
<br />location of each of the areas proposed for rezoning. Public input was
<br />received by the Board regarding the proposed amendments prior to action
<br />by the Board of Commissioners.

<br />ZONING ATLAS AMENDMENTS

<br />Petition 84-06, Edward H. Sellers, Jr., township 4, Mooresville Road.
<br />Map/PIN 5613(06)-18-2727, wishes to rezone from RMF-6 to C-2. The
<br />original request was for a C-4 district. The Planning Board denied
<br />this request and granted Mr. Sellers a C-2 classification with a
<br />3-2 vote.

<br /> Mr. Edward H. Sellers, Jr., and Mrs. Edward H. Sellers, Sr., spoke
<br />in favor of the rezoning request, stating the family planned to locate a
<br />used car dealership on the property. Mr. Sellers explained he was in the
<br />process of filling in the site with the building to be located at the
<br />front of the lot on solid ground and ccars to be stored on the rear filled
<br />area. A letter was noted from Mr. F. E. Isenhour, Zoning Administrator,
<br />outlining the regulations for the use of a land fill area.
<br /> Mr. Dixie Upright questioned the plans for the fill in of the area
<br />near the creek located on the property. No one spoke against the rezoning
<br />request.
<br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Nash
<br />and unanimously carried, the Board approved Petition 84-06 as recommended
<br />by the Planning Board rezoning Map/PIN 5613(06)-18-2727 from RMF-6 to C-2.

<br />Petition 84-07, Orchard Electronics, Inc., township 3, Highway 73
<br />West. Map/PIN 4682-30-1562, 30-6373. Wishes to rezone from ARR/I-X
<br />to I-1. The Planning Board denied this request, feeling that the
<br />location for I-1 was too far from the major transportation corridors.

<br /> Mr. Joe Weddington, President of Orchard Electronics, Inc., requested
<br />approval of the rezoning petition and presented background information
<br />on the company and plans for future operation in the county. Mr. Phillip
<br />H. Smith, Sr., Executive Vice-President of the Concord/Cabarrus County
<br />Chamber of Commerce, urged the Board to vote in favor of the rezoning
<br />petition,'stating it would be a competitive industry and respect the
<br />natural resources in the county.
<br /> Residents of the area speaking in opposition to the rezoning of the
<br />property included Mr. Robert Shivadecker, Mr. John Riggs, III, Mr. Ed Stever,
<br />Mrs. McElroy, Mr. Wayne McBryde, and Mrs. Susan Riggs McBryde. They
<br />stated the area should remain residential and expressed concerns relating
<br />to the amount of noise, increased traffic, littering of highway, safety
<br />of children attending Odell School, pollution of streams, possibility of
<br />chemical explosions, and the future growth rate of the industry.
<br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Nash
<br />with Commissioners Barnhardt, Nash, and Milloway voting for and Commissioner
<br />Payne and Chairman Lentz voting against, the Board approved the rezoning
<br />of Map/PIN 4682-30-1562, 30-6373 located on Highway 73 west from ARR/I-X
<br />to I-1 as requested by Orchard Electronics, Inc.

<br />Petition 84-08, Luis Alvarez, township 4, Cannon Boulevard, at the
<br />intersection of Texas Street southside. Map/PIN 5622(09)-17-8385,
<br />wishes to rezone from 0-I to C-1. The original request was for a
<br />C-3 district. The Planning Board denied this request. Mr. Alvarez
<br />then asked for a C-1 district which was passed by a 3-2 vote.
