551 <br /> <br />(2) Consideration of the New Private Road Standards for the County. <br /> <br /> Mr. Thomas B. Robinson, Planning Director, reviewed the proposed <br />Private Road Standards to be included in the Cabarrus County Subdivision <br />Ordinance. <br />No one spoke either for or against the proposed Private Road Standards. <br />UPON MOTION of Commissioner Milloway, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following amendment to the <br />Cabarrus County Subdivision Ordinance. <br /> <br />PRIVATE ROAD STANDARDS <br /> <br /> The construction of Private Roads in Cabarrus County will serve lots <br />within subdivisions that do not have access to state-maintained roads. <br />The purpose of this provision is to insure all lots have documented legal <br />right-of-way and to insure adequate access is allowed for residents and <br />emergency vehicles. <br /> <br /> Private Roads may be permitted in subdivisions where one or more of <br />the following conditions exist: <br /> <br />(1) Traffic volume would be small. <br />(2) The subdivision consists of ten (10) or less lots. <br />(3) The division would preserve a natural area through deed <br /> restrictions and special design features. <br />(4) The division is adjacent to property using an existing private <br /> road for access. <br />(5) The property does not abut major street. <br />(6) The road would not be accepted by the State even if built to <br /> their standards because of the iow housing density or length. <br /> <br /> Once the Private Road is constructed, an agreement between the property <br />owners must be made in regard to the maintenance of the road. This must be <br />in the form of a road maintenance agreement or declaration. The road will <br />not be maintained by the State nor by the County since Private Roads are not <br />built to state standards. <br /> <br /> There will be three (3) Classes of Roads, each having a forty-five <br />(45) foot right-of-way. Class C Roads will accommodate 1-3 lots, Class B <br />Roads will accommodate 4-6 lots, Class A Roads will accommodate 7-10 lots. <br />Subdivisions with more than ten (10) lots will be covered by the Subdivision <br />Regulations of Cabarrus County. The roads constructed under the Private <br />Road provision will be constructed and maintained in a manner as to provide <br />adequate access especially for emergency vehicles. The required clearances <br />and turning specifications will be discussed in the specification requirement <br />section. <br /> <br /> Construction of the Private Road must be inspected and approved by the <br />Cabarrus County Planning Department. The road will be inspected during <br />the construction stage in order that any changes necessary to insure approval <br />can be made before final approval. The property owner must contact the <br />Planning Department prior to the start of grading so that the inspections <br />can be scheduled during the construction process. The inspections by <br />the Planning Department are made only to insure the road is built to the <br />required dimensions, that an acceptable stone surface is provided, any <br />disturbed areas are seeded in permanent vegetation and the road sign is in <br />place. The person having the road built should have a qualified grading <br />contractor to insure that adequate methods and materials are used. <br /> <br />NOTE: <br /> <br />The construction of a Private Road must conform with the require- <br />ments of the North Carolina Sedimentation and Erosion Control <br />Ordinance. This ordinance requires that precautions be taken to <br />prevent damage by soil erosion or sedimentation regardless of the <br />amount of land disturbance. <br /> <br />GENERAL SUBDIVISION APPROVAL SEQUENCE <br /> <br />(i) <br /> <br />Submit request for subdivision and Private Road to Cabarrus County <br />Planning Department. Check proposed road name with Planning Department <br />Master Road Name List to avoid duplication or similarity of road name. <br /> <br /> <br />
