6 <br /> <br />The effluent of all package treatment plants and single-family <br />surface discharge systems shall be monitored by the Cabarrus County <br />Health Department for environmental impact on surface waters at a <br />minimum of once per year. Systems out of compliance with effluent <br />limitations established with the North Carolina Administrative Code <br />shall be reported to the North Carolina Department of Natural <br />Resources and Community Development for enforcement action. In <br />addition, these systems shall be monitored by the Cabarrus County <br />Health Department at least twice within a six month period after <br />the deadline imposed for compliance by the Department of Natural <br />Resources and Community Development to assure that compliance has <br />been obtained. If, at either of these two monitoring inspections, <br />the system is found to be out of compliance with the applicable <br />requirements cited above, then the party in violation thereof shall <br />be punished as provided in General Statutes 130(A)-25. <br /> <br />A violation of this ordinance shall subject the part in violation to <br />punishment as provided in G. S. 130(A) of the General Statutes of <br />North Carolina. <br /> <br />D. This ordinance will become effective August 1, 1984. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br />unanimously carried, the Board reappointed Mr. Scott Trott to the Cabarrus- <br />Rowan Park Commission for a term of four years ending July 1, 1988, as <br />recommended by the Cabarrus-Rowan Park Commission. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Nash <br />and unanimously carried, the Board appointed Miss Sharon Propst as the <br />Youth Member of the Cabarrus County Parks and Recreation Advisory Commission <br />for a term ~of one year ending July 31, 1985. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board moved that the proposed Restrictive Covenants <br />for the Old Cabarrus County Courthouse be reworded by Mr. 'John R. Boger, <br />Jr., County Attorney, to designate Cabarrus County as the owner of the <br />property and Historic Cabarrus, Inc., as the Lessee. <br /> UPON MOTION o.f Commissioner Milloway, seconded by Commissioner Nash <br />with Commissioners Milloway, Nash, and Barnhardt and Chairman Lentz voting <br />for and Commissioner Payne abstaining, the Board authorized the Chairman <br />to sign the following Restrictive Cov'e~ants on behalf of Cabarrus County. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />RESTRICTIVE COVENANTS <br /> <br /> THAT WHEREAS, the COUNTY OF CABARRUS is the Owner and HISTORIC CABARRUS, <br />INC., is the Lessee of that certain tract or parcel of land in the County of <br />Cabarrus, North Carolina, upon which is located the Old Cabarrus County <br />Courthouse; and <br /> <br /> WHEREAS, the Cabarrus County Board of Commissioners and Historic <br />Cabarrus, Inc., have applied to the North Carolina Division of Archives and <br />History, Department of Cultural Resources, for a matching grant of federal <br />funds pursuant to the provisions of the National Historic Preservation Act <br />of 1966 (P.L. 89-665) for the purpose of completing exterior renovation of <br />the Old Cabarrus County Courthouse; and, <br /> <br /> WHEREAS, the North Carolina State Division of Archives and History, <br />Department of Cultural Resources, has made a grant of THIRTY-TWO THOUSAND <br />AND NO/100 DOLLARS ($32,000.00) available to the Cabarrus County Board of <br />Commissioners and Historic Cabarrus, Inc., upon conditiQn that the.County of <br />Cabarrus and Historic Cabarrus, Inc., place the following restrictions upon <br />the property to which the grant applies. <br /> <br /> NOW, THEREFORE, the Cabarrus County Board of Commissioners as owners <br />and Historic Cabarrus, Inc., as Lessee, of that certain tract or parcel of <br />land in the County of Cabarrus, North Carolina, do hereby impose upon said <br />tract or parcel of land the following restrictive covenants which shall be <br />binding and enforceable for a period of ten (10) years from the date of <br />recordation of this instrument: <br /> <br /> <br />
