RESTRICTIVE COVENANTS <br /> <br /> 1. The County of Cabarrus and Historic Cabarrus, Inc., covenant and <br />agree to continuously maintain, repair and administer the premises herein <br />described so as to preserve the historical integrity of features, materials, <br />appearance, workmanship and environment of the premises. Adequate staffing <br />and maintenance shall be continuously provided from funds other than federal <br />or state governmental sources. <br /> <br /> 2. No person in the United States shall, on account of race, color or <br />national origin, be excluded from participation in, be denied the benefits <br />of, or be otherwise subjected to discrimination in the restoration and use <br />of the property described herein. The owners covenant and agree to conform <br />with all requirements of Title VI of the Civil Rights Act of 1964 (P.L. 88- <br />352) and all requirements imposed by or pursuant to the Department of Interior <br />Regulation (43 CVS 17) issued pursuant to that title, in administering said <br />premises. <br /> <br /> In the event of a violation of these restrictions, the North Carolina <br />Department of Cultural Resources, its successors and assigns, shall have the <br />right to take such action as it deems necessary to enforce compliance with <br />these restrictions. <br /> <br /> Officials of the North Carolina Department of Cultural Resources, its <br />successors and assigns, shall have the right to enter the property herein <br />described at all reasonable times for the purpose of inspecting said property <br />to determine if the County of Cabarrus and Historic Cabarrus, Inc., their <br />successors and assigns, are complying with said restrictive covenants. <br /> <br /> IN TESTIMONY WHEREOF, the County of Cabarrus and Historic Cabarrus, <br />Inc., have caused this instrument to be executed in their names and their <br />corporate seals to hereunto affixed, all by authority duly given this the <br />16th day of July, 1984. <br /> <br />COUNTY OF CABARRUS <br /> <br />By <br /> <br />Chairman, Cabarrus County Board <br />of Commissioners <br /> <br />ATTEST: <br /> <br />ATTEST: <br /> <br />Clerk <br /> <br />HISTORIC CABARRUS, INC. <br />By <br /> <br />Title <br /> <br />Title <br /> <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Nash <br />and unanimously carried, the Board accepted the recommendation from <br />Mayor W. Ralph Austin and appointed Mr. Ben Shue to the position previously <br />held by Mr. Billy R. Hatley on the Mt. Pleasant Planning and Zoning Board <br />and reappointed Mr. Harry Lassiter to the Mt. Pleasant Planning and Zoning <br />Board. Both terms of office will expire on June 30, 1987. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board accepted the recommendation from Mayor <br />W. Ralph Austin and appointed Mr. Manley Reid Heilig and Mr. Gene Eagle <br />as extraterritorial jurisdiction members on the Mt. Pleasant Zoning Board <br />of Adjustment for a term of three years ending on June 30, 1987. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the following rosters of qualified <br />firemen for the various volunteer fire departments in Cabarrus County as <br />submitted by Mr. James L. Pharr, Fire Marshal, for certification to the <br />North Carolina Firemen's Pension Fund in Raleigh. <br /> <br /> <br />
