18 the accumulation of dislodged trees in stream channels causing flooding of adjacent cropland and wooded areas, and the accumulation of dislodged trees and woody debris in public road culverts causing flooding and damages to roadways and bridges. Mr. Wetmore advised the Board that $16,000.00 in Emergency Watershed Protection Program funds was available to the County for the removal of the fallen trees from the streams and for the removal of the trees on the stream banks which have been undermined and are leaning. He further stated that the County would be required to provide $4,000.00 in local matching funds to receive the emergency assistance. UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt and unanimously carried, the Board of Commissioners on behalf of Cabarrus County accepted the Emergency Watershed Protection funds offered by the Soil Conservation Service, appropriated from the Contingency Fund the sum of $4,000.00 as the matching portion for the County, and directed that necessary procedures be taken to bid the project. The Project Agreement as approved between Cabarrus County and the Soil Conservation Service is as follows. STATE North Carolina PROJECT Cabarrus Emergency Protection CONTRACT NO. UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE PROJECT AGREEMENT THIS AGREEMENT, made this day of ~ . ~, 19__, by and between the Cabarrus County Board of Commissioners, called the Sponsors and the Contracting Local Organization; and the Soil Conservation Service, United States Department of Agriculture, called SCS. WHEREAS, under the provisions of Section 216 of Public Law 81-516, Emergency Watershed Protection Program, SCS is authorized to assist the sponsors in relieving hazards created by natural disasters that cause a sudden impairment of a watershed; NOW THEREFORE, in consideration of the premises and of the several promises to be faithfully performed by the parties hereto as set forth, the Sponsors, the Contracting Local Organization, and SCS do hereby agree as follows: A. It is agreed that the following-described work is to be performed at an estimated cost of $20,000.00: Removal of debris from selected portions of channels within Cabarrus County. B. The Sponsors will: 1. Accept all financial and other responsibility for excess costs resulting from their failure to obtain, or their delay in obtaining adequate land and water rights, permits, and licenses needed for the works of improvement described in A. 2. If applicable, complete the attached "Clean Air and Water Certification" and comply with the attached "Clean Air and Water Clause." C. The Contracting Local Organization will: 1. Provide 20 percent of the cost of the works of improvement described in A. This cost to the Contracting Local Organization is estimated to be $4,000.00. 2. Appoint a Contracting Officer and an authorized representative who is to have authority to act for the Contracting Officer, listing their duties, responsibilities, and authorities. Furnish this information in writing to the State Administrative Officer. 3. Be responsible for all administrative expenses necessary to arrange for and procure the works of improvement described in Section A. These administrative expenses include but shall not be limited to facilities, clerical personnel, and legal counsel including such attorneys deemed necessary by SCS to resolve any legal matters.
