18 <br /> <br />the accumulation of dislodged trees in stream channels causing flooding of <br />adjacent cropland and wooded areas, and the accumulation of dislodged trees <br />and woody debris in public road culverts causing flooding and damages to <br />roadways and bridges. Mr. Wetmore advised the Board that $16,000.00 in <br />Emergency Watershed Protection Program funds was available to the County <br />for the removal of the fallen trees from the streams and for the removal of <br />the trees on the stream banks which have been undermined and are leaning. <br />He further stated that the County would be required to provide $4,000.00 <br />in local matching funds to receive the emergency assistance. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board of Commissioners on behalf of Cabarrus <br />County accepted the Emergency Watershed Protection funds offered by the <br />Soil Conservation Service, appropriated from the Contingency Fund the sum <br />of $4,000.00 as the matching portion for the County, and directed that <br />necessary procedures be taken to bid the project. The Project Agreement <br />as approved between Cabarrus County and the Soil Conservation Service is <br />as follows. <br /> <br /> STATE North Carolina <br /> PROJECT Cabarrus Emergency <br /> Protection <br /> CONTRACT NO. <br /> <br />UNITED STATES DEPARTMENT OF AGRICULTURE <br /> SOIL CONSERVATION SERVICE <br /> <br /> PROJECT AGREEMENT <br /> <br /> THIS AGREEMENT, made this day of ~ . ~, 19__, by and <br /> between the Cabarrus County Board of Commissioners, called the Sponsors <br /> and the Contracting Local Organization; and the Soil Conservation Service, <br /> United States Department of Agriculture, called SCS. <br /> WHEREAS, under the provisions of Section 216 of Public Law 81-516, <br /> Emergency Watershed Protection Program, SCS is authorized to assist the <br /> sponsors in relieving hazards created by natural disasters that cause a <br /> sudden impairment of a watershed; <br /> <br /> NOW THEREFORE, in consideration of the premises and of the several <br /> promises to be faithfully performed by the parties hereto as set forth, <br /> the Sponsors, the Contracting Local Organization, and SCS do hereby agree <br /> as follows: <br /> <br />A. It is agreed that the following-described work is to be performed at <br /> an estimated cost of $20,000.00: <br /> Removal of debris from selected portions of channels <br /> within Cabarrus County. <br /> <br />B. The Sponsors will: <br /> 1. Accept all financial and other responsibility for excess costs <br /> resulting from their failure to obtain, or their delay in <br /> obtaining adequate land and water rights, permits, and licenses <br /> needed for the works of improvement described in A. <br /> 2. If applicable, complete the attached "Clean Air and Water <br /> Certification" and comply with the attached "Clean Air and Water <br /> Clause." <br /> <br />C. The Contracting Local Organization will: <br /> 1. Provide 20 percent of the cost of the works of improvement <br /> described in A. This cost to the Contracting Local Organization <br /> is estimated to be $4,000.00. <br /> 2. Appoint a Contracting Officer and an authorized representative <br /> who is to have authority to act for the Contracting Officer, <br /> listing their duties, responsibilities, and authorities. Furnish <br /> this information in writing to the State Administrative Officer. <br /> 3. Be responsible for all administrative expenses necessary to <br /> arrange for and procure the works of improvement described in <br /> Section A. These administrative expenses include but shall not <br /> be limited to facilities, clerical personnel, and legal counsel <br /> including such attorneys deemed necessary by SCS to resolve any <br /> legal matters. <br /> <br /> <br />
