19 <br /> <br />Do <br /> <br />4. Procure the works of improvement described in A. in accordance <br /> with specifications furnished by SCS, and specifications <br /> furnished by the Contracting Local Organization when concurred <br /> in by the State Administrative Officer. This procurement will <br /> be made as follows: <br /> (a) Prepare and issue written request(s) for quotations. <br /> 0ral requests for quotations may be made when such method <br /> is concurred in by the State Administrative Officer. <br /> (b) Receive and protect quotations. Determine the lowest <br /> qualified vendor and with written concurrence of the State <br /> Administrative Officer, make such procurement. <br /> (c) Secure written concurrence of the State Administrative <br /> Officer before waiving the requirements for any material <br /> certifications. <br />5. Secure concurrence of the State Administrative Officer before <br /> issuing modifications to the procurement, and issue modifications <br /> recommended by SCS. <br />6. Pay the vendor as required by the terms of the procurement <br /> document. Submit billings to SCS on Form SF-270. <br />7. Secure written concurrence of the State Administrative Officer <br /> before terminating the vendor's right to proceed and declaring <br /> the vendor in default, and take such actions when requested to do <br /> so by the State Administrative Officer. <br />8. Arrange for and conduct final inspection of completed works of <br /> improvement with SCS to determine whether all work has been <br /> performed in accordance with specifications. <br /> Hold and save SCS free from any and all claims or causes of <br /> action whatsoever resulting from the obligations undertaken by <br /> the contracting Local Organization under this agreement or <br /> resulting from the work provided for in this agreement. <br /> Retain all records dealing with the award and administration of <br /> the contract for 3 years from the date of the Contracting Local <br /> Organization's submission of the final request for payment or <br /> until final audit findings have been resolved. If any litigation <br /> is started before the expiration of the 3-year period, the records <br /> are to be retained until the litigation is resolved. Make such <br /> records available to the Comptroller General of the United States <br /> or his duly authorized representative and accredited representatives <br /> of the Department of Agriculture or cognizant audit agency for the <br /> purpose of making audit, examination, excerpts, and transcripts. <br /> <br /> SCS will: <br />1. Provide 80 percent of the cost of the works of improvement described <br /> in A. This cost to SCS is estimated to be $16,000.00. <br />2. Provide authorized assistance such as estimates of costs, results <br /> of tests and studies as available, design and layout, and <br /> specifications. <br />3. Provide the services of a Government Representative. <br />4. Provide the Services of Government Inspectors, as necessary. <br />5. Make payment to the Contracting Local Organization for SCS's <br /> share of the cost upon receipt and approval of Form SF-270. <br /> <br /> It is mutually agreed that: <br />1. This agreement shall become null and void 90 calendar days <br /> after the date SCS has executed this agreement in the event <br /> the work has not been commenced. <br />2. The State Administrative Officer may make adjustments in the <br /> estimated cost to SCS set forth in D.1. for performing the works <br /> of improvement. No adjustment shall change the cost-sharing <br /> assistance to be provided by SCS as set forth in D.1. nor <br /> reduce funds below the amount required to carry out SCS's share of <br /> the work. <br />3. The procurement for accomplishing the works of improvement <br /> described in Section A. will not be made from the Sponsors, the <br /> Contracting Local Organization, or firms in which any official <br /> of such organization or any member of such official's immediate <br /> family has direct or indirect interest in the pecuniary profits <br /> or contracts of such firm. <br /> <br />10. <br /> <br /> <br />
