34 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Milloway <br />with Commissioners Milloway, Nash, and Payne and Chairman Lentz voting for <br />and Commissioner Barnhardt voting against, the Board appropriated $10,723.00 <br />from the Contingency Fund to Capital Outlay/Animal Shelter to provide <br />funding for the recommended work at the Animal Shelter. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br />Milloway with Commissioners Barnhardt, Milloway, and Nash voting for <br />and Commissioner Payne and Chairman Lentz voting against, the Board moved <br />to go into Executive Session for legal advice in regards to the Cabarrus <br />County fairgrounds property. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved to terminate the Executive Session. <br /> Mr. John R. Boger, Jr., County Attorney, reported that the Board had <br />discussed the legal status of two parcels of land during the Executive <br />Session. The first parcel was the ll.98-acre tract that was conveyed to <br />the Cabarrus County Agricultural Fair, Inc., by deed in July, 1955, with <br />the reversionary provision that the land would revert to the County if it <br />ceased to be used for a fair. Mr. Boger reported that he concurred with <br />the letter from the Institute of Government stating the opinion that this <br />land was the property of the Fair Association subject only to the possibility <br />of reversion. The second tract of land discussed by the Board during the <br />Executive Session was the 8 to 10 acres located south of the fairgrounds <br />property on Union Cemetery Road. According to Mr. Boger, this second tract <br />of land is owned by Cabarrus County and has been used by the Fair Association <br />for the rides and carnival portion of the fair. Mr. Boger stated that he <br />had been instructed by the Board of Commissioners in the Executive Session <br />to negotiate with the Fair Association concerning the use by the Fair <br />Association of the County-owned property for future fairs after the 1984 <br />fair scheduled for September. In conclusion, Mr. Boger~stated he would <br />make a report to the Board and to the public regarding this matter at a <br />later date. <br /> Chairman Lentz stated that it was not the intent of the Board to <br />jeopardize the operation of the fair but to give the public the facts <br />regarding the fairgrounds property. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board declared the items as listed below as surplus <br />to the needs of the County and further resolved that these stated items be <br />disposed of by public auction on September 29, 1984, at 10:00 A.M. <br />Confiscated property and other unclaimed property in the possession of the <br />Sheriff's Department will also be offered for sale on that date.
