0 <br /> <br /> Mr. F. A. Rankin, Planning Board Chairman, briefly reviewed the <br />proposed new multi-family district which would prohibit the establishment <br />of mobile home parks. <br /> Mr. Bill Powlas stated that those persons living in the multi-family <br />districts should have the right to ask for the RMF-7A zoning if they wish <br />to do so at no charge as in his opinion the proposed district was the <br />correction of a mistake made at the time of the adoption of the Zoning <br />Ordinance. <br /> Mr. Thomas B. Robinson, Planning Director, reported that the Planning <br />staff had conducted an extensive study of residents of the multi-family <br />districts of RMF-7 and RMF-6. He stated that only four of those residents <br />wished to remain zoned as RMF-7. He proposed that the Board of Commissioners <br />direct the Planning staff to go back and reaffirm the wishes of the people <br />in that district and if those residents desire to be rezoned to RMF-7A that <br />the Planning staff initiate the Zoning Atlas amendments. He further stated <br />that the zoning in a district would remain the same if there was any opposition <br />from residents of the district. In conclusion, he stated that all the <br />rezoning requests would have to follow the normal process through the <br />Planning Board and Board of Commissioners. <br /> There being no one else to speak regarding the proposed new district, <br />the public hearing was closed. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the creation in the zoning districts <br />of Cabarrus County a zone known as RMF-7A with the District Statements of <br />Intent, the Schedule of Use Regulations, and Schedule of Development Standards <br />as recommended by the Planning Board (see above). <br /> Further study is to be made by the Planning' staff regarding the new <br />zoning district. <br /> <br />(2) The Lot Reduction Amendment (See below). The Planning Board <br /> unanimously approved the Lot Reduction Amendment. <br /> <br /> LOT SIZE REDUCTION <br />ZONING TEXT AMENDMENT <br /> <br />Amend: Section 3.3-2 Establishemnt of Development Standards: <br /> <br />From "Except as otherwise specifically provided in this ordinance..." <br /> <br />To <br /> <br />"Except as permitted in Section 3.10 and as otherwise <br />specifically provided in this ordinance..." <br /> <br />Add: <br /> <br />Section 3.10 Ten-Year Growth Transition Overlay District <br /> <br />Section 3.10-1 Intent: The Ten-Year Growth Transition OverlaY <br />District is intended to promote high density development in the <br />county in areas where county or municipal water and sewer will <br />be provided within a ten year time period in accordance with <br />the county's adopted Comprehensive Plan. It is further intended <br />that as additional county or municipal plans for water and sewer <br />emerge that this District Boundary be amended to reflect these <br />changes. <br /> <br />Section 3.10-2 District Boundary Amendment: The Ten-Year Growth <br />Transition Overlay District Boundary shall be established in <br />accordance with Section 2 of this Ordinance. This Boundary may <br />be amended in accordance with Section 10 of this Ordinance. <br /> <br />Section 3.10-3 Permitted Uses and Development Standards: Any <br /> <br />use permitted in the applicable underlying Zoning District shall <br />be allowed. In addition, rezonings for higher density residential <br />development proposals (R-15 and higher including Mobile Home <br />Park development) shall as a matter of policy be limited to this <br />Ten-Year Growth Transition Overlay District. Exceptions to this <br />policy can be made by the Board of Commissioners where sound land <br />use planning and overall well being of the general public dictate. <br /> <br /> A. Where residence(s) will be serviced by public <br /> water or sewer facilities, the lot area need <br /> only be thirty thousand (30,000) square feet. <br /> In such cases the other dimensional requirements <br /> will comply with that of the R-30 district. <br /> <br /> <br />
