62 <br /> <br /> Commissioner Payne requested a report from the Planning Department <br />regarding the number of streets for which property owners had obtained <br />their share of funds for paving under the property owners participation <br />program and there were no State funds available for the work. <br /> Mr. Gary Steeley, Chief Animal Control Officer, presented the proposed <br />Animal Control Ordinance amendment to define the "owner" of an animal as <br />recommended by the Cabarrus County Animal Control Advisory Board. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz with <br />Commissioners Payne, Milloway, and Nash and Chairman Lentz voting for and <br />Commissioner Barnhardt voting against, the Board approved on first reading <br />the following amendment to the Cabarrus County Animal Control Ordinance. <br /> <br />ARTICLE IV <br /> <br /> For the purpose of this Ordinance "owner" of an animal <br />shall include any person, firm, corporation or association <br />that feeds, provides shelter for or otherwide cares for said <br />animal for a period of three or more days. <br /> <br /> Mr. Brady Black, spokesman for the Board of Directors of the Cabarrus <br />County Farmers Market, Inc., presented the request that the Board consider <br />making available an eight-acre parcel of land owned by Cabarrus County and <br />located between the Cabarrus County Fairgrounds and the County School Bus <br />Garage on Union Cemetery Road. He stated the purpose of the request is to <br />allow the Cabarrus County Farmers Market, Inc., to develop a permanent <br />farmers market for Cabarrus County and to receive funding from the State or <br />other sources for construction of permanent facilities. Stating that <br />local legislators have already promised partial funding for a permanent <br />marketing facility in Cabarrus County, Mr. Black requested that the <br />property be made available in a way that this State funding could be <br />obtained. Mr. Black further asked that restrictions be placed on the <br />property to ensure long.term development of a permanent marketing facility. <br /> Mr. Alvin M. Stanford, Agricultural Extension Chairman, spoke in <br />support of the request by the Cabarrus County Farmers Market, Inc. <br /> Mr. J. Archie Smith, member of the Board of Directors for the Cabarrus <br />County Farmers Market, Inc., stated that the organization would be willing <br />to share the property with the Cabarrus County Fair Association during the <br />week of the fair in order to alleviate the parking problems in the area at <br />that time. <br /> Mrs. Sue Casper, President of Keep Cabarrus County Beautiful, Inc., <br />expressed concern regarding the maintenance of the fairgrounds property and <br />the eight adjoining acres owned by the County. She asked that the Board <br />take the appropriate measures to best utilize the property and insure year <br />round maintenance. <br /> The motion by Commissioner Barnhardt and seconded by Commissioner <br />Milloway to appoint an advisory committee to investigate the possibility <br />of coming to an agreement with the Fair Association for use of the fairgrounds <br />property for the purpose as requested by the Cabarrus County Farmers Market, <br />Inc., was withdrawn after discussion. <br /> Mr. John R. Boger, Jr., County Attorney, reported that he would be <br />meeting on Thursday with Mr. Clyde Propst of the Cabarrus County Fair <br />Association as requested by the Board on August 20, 1984. In regards to <br />the request by the Cabarrus County Farmers Market, Inc., Mr. Boger advised <br />the Board of the following possible ways that the Board could allow the <br />use of County property. <br /> <br />(1) Lease for one year by motion of the Board. <br />(2) Lease for one to ten years after a public hearing. <br />(3) Sell by public auction, sealed bids, or negotiated offer, <br /> advertisement, and upset bids. <br /> <br /> The following motion by Chairman Lentz and seconded by Commissioner <br />Payne failed with Commissioner Payne and Chairman Lentz voting for and <br />Commissioners Milloway, Barnhardt, and Nash voting against. <br /> <br /> That the Board takes this request from the Cabarrus County <br />Farmers Market, Inc., and finds there is a need for that purpose, <br />and with future negotiations the Board would keep that utmost in <br />mind and possibly come up with suitable arrangements for all <br />concerned. <br /> <br /> <br />
