88 <br /> <br /> Mr. William G. Alexander asked the Board to consider tabling the <br />proposed amendment for further consideration or to deny the petition. <br />He stated the matter should be considered in terms of long range planning <br />for Cabarrus County and not as a stop gap measure for the Martin Marietta <br />quarry. <br /> Mr. Gene Walker of Concrete Supply Company spoke against the proposed <br />zoning text amendment, stating that Martin Marietta Aggregates would <br />provide a source to obtain raw materials for concrete within the county <br />and at a reasonable price. <br /> Mr. Dennis Shultz, speaking for himself and on behalf of 150 residents <br />of the Midland area, spoke in favor of the zoning text amendment to make <br />the extraction of earth products a conditional use in the ARR district. <br />He expressed concern that the quarry would create a traffic problem and <br />stated in his opinion the control of the operations of the quarry should <br />be in the hands of local officials. <br /> Mr. Freeman Jones of Morrison Road stated concern regarding the <br />location of a rock quarry in a residential community. <br /> Ms. Mandy Tucker and Mr. Rick Pegram expressed concern that the <br />proposed quarry would disturb the style of country living now found in <br />that area of the county. <br /> Ms. Tere Wood, President of the Midland Community Association, asked <br />approval of the text amendment to ensure control of the use of the land <br />at the local level rather than by state agencies. She further asked that <br />the Board consider long range planning for the county. <br /> Mr. F. W. Pearson expressed concern regarding the integrity of the <br />company of Martin Marietta Aggregates. <br /> Motion was made by Commissioner Nash and seconded by Commissioner <br />Barnhardt that Petition 84-01 be denied by the Board. A substitute <br />motion was made by Commissioner Payne to table Petition 84-01. There <br />was no second to the substitute motion. <br /> At that time Mr. Mitchell Haigler, who submitted the zoning text <br />amendment petition on behalf of the Midland Community Association, <br />requested the withdrawal of Petition 84-01 to make extraction of earth <br />products a conditional use in the ARR zone. <br /> Chairman Lentz stated that the Chair recognized the withdrawal of <br />the petition. Commissioners Barnhardt and Milloway called to question the <br />motion before the Board to deny the petition. In response to the request <br />by Chairman Lentz for a ruling regarding the request for withdrawal of <br />the petition, Mr. John R. Boger, Jr., County Attorney, stated that the <br />petition could not be withdrawn at that time as there was a motion and a <br />second before the Board unless the Board voted to allow the withdrawal. <br />Chairman Lentz stated that the Board would vote on the motion on the floor <br />at that time. <br /> Voting on the motion by Commissioners Nash and seconded by Commissioner <br />Barnhardt that Petition 84-01 be denied by the Board was as follows. <br /> <br />Voting for the motion - Commissioners Nash, Barnhardt, and Milloway <br />Voting against the motion - Chairman Lentz and Commissioner Payne <br /> <br />(2) <br /> <br />Petition 84-02. Page 18, Section 3.24. Amend the Schedule of <br />Use Regulations to allow Rest and Convalescent Homes as a conditional <br />use in the RMF-7, RMF-7A and RMF-6 zoning districts. The Planning <br />Board approved this request on the grounds it may have been an <br />oversight as Rest and Convalescent Homes are allowed as a conditional <br />or permitted use in all other residential districts. <br /> <br /> There was no one present to speak either for or against the zoning <br />text amendment. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved Petition 84-02 <br />with the addition of Nursing Homes as a conditional use in the RMF-7, <br />RMF-7A and RMF-6 zoning districts. The amendment as approved is as follows. <br /> <br />Page 18, Section 3.2-4. Amend the Schedule of Use Regulations <br />to allow Rest and Convalescent Homes and Nursing Homes as a <br />conditional use in the RMF-7, RMF-7A and RMF-6 zoning districts. <br /> <br /> <br />
