133 <br /> <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board adopted the following <br />Kannapolis Parking Lot Ordinance to be effective December 5, 1984. <br /> <br /> KANNAPOLIS <br />PARKING LOT ORDINANCE <br /> <br /> Pursuant to North Carolina General Statute 153A-139 and related <br />statutes and upon written request by the owner of the parking areas <br />pursuant to said statute, BE IT ORDAINED by the Board of Commissioners <br />of Cabarrus County, North Carolina, that the following parking ordinance <br />be and the same is hereby adopted: <br /> <br />SECTION 1. DEFINITIONS: - <br /> <br /> For the purpose of this ordinance the following definitions shall <br />apply: <br /> <br /> Vehicle: Every device in, upon, or by which any person or property <br />is or may be transported or drawn upon a street or highway. <br /> <br /> Parking: The stopping or standing of a vehicle, whether occupied <br />or not, otherwise than temporarily for the purpose of and while actually <br />engaged in loading or unloading. <br /> <br /> Parking Space: A space sufficient in size to accommodate a standard <br />automobile, which space is designated by appropriate lines and appropriate <br />markings or signs. <br /> <br />Person: Any person, firm, association or corporation. <br /> <br />SECTION 2. <br /> <br /> This ordinance shall apply to the parking areas (herein "Cannon parking <br />areas") owned by Cannon Mills Realty and Development Corporation, (herein <br />"Cannon") individually, and as General Partner as shown on Exhibit A attached <br />hereto and made a part hereof by reference, for parking for Cannon Village <br />(downtown Kannapolis) and/or Oak Avenue Mall. Parking any vehicle in <br />said Cannon parking areas shall be unlawful unless permitted by the provisions <br />of this ordinance. <br /> <br />SECTION 3. <br /> <br /> Parking shall be permitted in the Cannon parking areas hereinbefore <br />defined only in parking spaces and only as follows: <br /> <br /> A. Public Parking: Various spaces are hereby designated as public <br />parking spaces. The number and location of these parking spaces shall be <br />determined by Cannon and these spaces shall be designated by sign or other <br />markings. Persons transacting any business in Cannon Village (downtown <br />Kannapolis) and/or Oak Avenue Mall may park their vehicles for a period <br />of not longer than four (4) hours in the parking spaces designated for <br />public parking. <br /> <br /> B. Handicapped Parking. Various parking spaces are hereby <br />designated as parking spaces for handicapped persons. Only vehicles <br />permitted to park in handicapped parking spaces by North Carolina law may <br />be parked in these spaces. The number and location of these spaces shall <br />be determined by Cannon and the spaces shall be designated by sign or <br />other markings. <br /> <br /> C. Reserved Spaces: Various parking spaces are hereby designated <br />as reserved spaces. These spaces shall be for Cannon, and its designated <br />employees and the tenants and their designated employees. The number and <br />location of these spaces shall be determined by Cannon. Cannon shall <br />assign these spaces to its employees and its Tenants and shall designate <br />the spaces by sign or other markings. The Tenants may assign their <br />allotted spaces to their'employees. Cannon may require the display of <br />parking stickers, permits or other emblems to identify vehicles eligible <br />for parking in the reserved spaces. Vehicles not displaying the required <br />identification emblem shall not park in reserved spaces. <br /> <br /> <br />
