134 <br /> <br /> D. Repair and Emergency Vehicles: Vehicles being used during repair <br />or construction work, when it is necessary for them to be parked in a <br />space other than a parking space, and emergency vehicles being used for <br />emergency purposes are hereby exempted from this ordinance. <br /> <br />SECTION 4. PENALTIES <br /> <br /> A. Obedience to this ordinance is chargeable to the person actually <br />operating or in control of the vehicle at the time it is parked in said <br />Cannon parking areas hereinbefore described; provided that proof of <br />ownership of any vehicle found parked in violation of this ordinance shall <br />be prima facie evidence that said owner parked said vehicle. <br /> <br /> B. The Police Chief of Kannapolis or any of his deputies (policemen) <br />shall cause to be attached to any vehicle parked in violation of the <br />provisions of this ordinance a notice to the owner or operator thereof <br />to report to the Kannapolis Police Department in regard to such violation. <br /> <br /> C. Each such owner or operator may, within twenty-four (24) hours of <br />the time when such notice was attached to such vehicle, submit to the <br />violation and pay, as a penalty in full satisfaction of such violation, <br />the sum of Five Dollars ($5.00). The failure of such owner or operator <br />to make such payment of said amount, within the said twenty-four hours <br />shall render such owner or operator subject to punishment for a misdemeanor <br />as hereinafter provided. <br /> <br /> D. The violation of any of the provisions of this ordinance shall be <br />a misdemeanor and punishable by fine not to exceed Fifty Dollars ($50.00) <br />or imprisonment not to exceed thirty (30) days, or by both such fine and <br />imprisonment in the discretion of the Court. <br /> <br /> E. Any vehicle parked in violation of this ordinance may be removed <br />from the property by Cabarrus County or any agent of Cabarrus County to <br />a storage area or garage. If a vehicle is so removed the owner, as a <br />condition of regaining possession of said vehicle, shall be required to <br />pay to Cabarrus County or directly to the removal and storage agent all <br />reasonable costs incidental to the removal and storage of the vehicle. <br /> <br /> F. The Deputy Sheriff (Policeman) on duty at the Kannapolis Police <br />Department shall accept designated penalties and issue receipts. The said <br />Deputy Sheriff (Policeman) or any employee in the Kannapolis Police <br />Department may accept the costs to the County incidental to the removal <br />storage of said vehicle. <br /> <br />week. <br /> <br />SECTION 5. <br /> <br />This ordinance shall apply twenty-four hours a day, seven days a <br /> <br /> SECTION 6. <br /> <br /> This ordinance shall be in full force and effect from and after the <br />5th of December, 1984. <br /> <br /> Exhibit A, the map showing the designated parking areas regulated by <br />the Kannapolis Parking Lot Ordinance, is on file in the County Manager's <br />Office and is adopted by reference. <br /> <br /> The Honorable James C. Johnson, Jr., State Senator, requested the <br />opportunity of meeting monthly with the Board of Commissioners to review <br />the activities of the North Carolina General Assembly directly affecting <br />the operation of County government. He offered his assistance in the <br />drafting of bills for the County and stated it was his intention to consult <br />the Board of Commissioners before introducing any bill regarding Cabarrus <br />County in the General Assembly. <br /> The Board received the following recommendations from the Executive <br />Committee of the Cabarrus County Parks and Recreation Advisory Commission <br />for appointment to the Parks and Recreation Advisory Commission to fill the <br />positions previously held by Messrs. M. L. Barnes, Jim Herman, and John Parker. <br /> <br /> Mrs. Donna Davidson, Concord <br /> Mrs. Toni Troutman, Odell <br /> Mr. Kenneth Thompson, A. T. Allen-Wolf Meadow <br /> <br /> <br />
