141 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Thursday, January 3, 1985, in Courtroom 2 of the County Courthouse in <br />Concord, North Carolina, for a public hearing regarding proposed Zoning <br />Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Ms. Debra Luckadoo-Shockley, member of the Cabarrus County Planning <br />staff, reviewed the location of the areas proposed for rezoning. Public <br />input was received by the Board prior to action regarding each of the <br />proposed amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) Petition 84-24. Withdrawn <br /> <br />(2) <br /> <br />Petition 84-25. Church of God Home for Children, township 4, 1-85 and <br />Orphanage Road, 1-85 near Highway 73, Map/PIN 5601-99-4237. Wishes <br />to rezone from RMF-7 to C-4. Planning Board denied this request <br />4 to 1 on the grounds that the intent of the zoning ordinance regarding <br />C-4 as a highway business district would not be met. <br /> <br /> Mr. Bob Willard, speaking on behalf of the Children's Home and Mr. <br />Jerry Smith and also representing the interests of Campbell & Walker <br />Advertising and their client, Cannon Village, and Horizon Outdoor <br />Advertising, requested the rezoning of the property to allow the erection <br />of an advertising sign. He stated the location of the proposed advertising <br />sign at this site would make possible the productive use of the land, <br />serve the needs of a major Kannapolis business, and make available needed <br />funds for the Children's Home. <br /> No one spoke in opposition to the requested rezoning. <br /> The motion by Commissioner Upright and seconded by Commissioner Barnhardt <br />to approve Petition 84-25 to rezone Map/PIN 5601-99-4237 from RMF-7 to <br />C-4 to permit the erection of an advertising sign failed by the following <br />vote. <br /> <br />Voting for - Commissioners Upright and Barnhardt <br />Voting against - Chairman Lentz and Commissioners Payne and Hamby <br /> <br />(3) Petition 84-26. Withdrawn <br /> <br />(4) <br /> <br />Petition 84-27. Floyd L. Carter, Jr., township 11, Commercial Park <br />Drive off Highway 29, Map/PIN 5610-81-1736. Wishes to rezone from <br />C-4 to I-1. This request was unanimously approved by the Planning <br />Board as it would be compatible with the existing industrial develop- <br />ment of Philip Morris, which is adjacent to the property. <br /> <br />Petition 84-36. J. Roy Davis Trust, S & D Coffee Company, Inc. and <br />Troutman Land Investments, Inc., township 2, Highway 29 and Rock <br />Hill Church Road, Map/PIN 5610(04)-82-6707, 5610(04)-83-6098, 5531. <br />Wishes to rezone from C-3 and C-4 to I-1. This request was unanimously <br />approved by the Planning Board as this would be compatible with <br />nearby I-1 and A-I zoning districts. <br /> <br /> Mr. Fletcher L. Hartsell, Jr., attorney representing American Display <br />Corporation and S & D Coffee Company, Inc., spoke in support of the approval <br />of Petitions 84-27 and 84-36. No one spoke in opposition to the rezoning <br />requests. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 84-27 by Floyd L. <br />Carter, Jr., to rezone property on Commercial Park Drive off Highway 29, <br />Map/PIN 5610-81-1736, from C-4 to I-1 and Petition 84-36,by J. Roy Davis <br />Trust, S & D Coffee Company, Inc and Troutman Land Investments, Inc., to <br />rezone property on Highway 29 and Rock Hill Church Road, Map/PIN 5610(04)-82- <br />6707, 5610(04)-83-6098, 5531, from C-3 and C-4 to I-1.
