142 <br /> <br />Beginning at an iron stake in the northern right-of-way of Rock <br />Hill Church Road, corner of Curtis Shoe; thence North 40-26 East <br />1,500 feet to an iron stake in the line of Cannon Holding Corporation; <br />thence with the line of Cannon Holding Corporation, South 14-01-25 <br />East, 685.41 feet to an iron spike; thence South 84-49-58 West <br />608.16 feet to an iron stake; thence South 5-10-02 East, 324.67 feet <br />to an iron stake; thence South 86-18 West, 425 feet to an iron stake <br />in the northern right-of-way of Rock Hill Church Road; thence with <br />said right-of-way 60 feet to the beginning, together with a 60-foot <br />right-of-way from U.S. Highway 29 to said tract. <br /> <br />(5) <br /> <br />Petition 84-28. Lynn H. Dagenhart, township 4, Kansas Street at <br />Dakota Street, Map/PIN 5612(08)-98-0983, 1758. Wishes to rezone <br />from R-9 to RMF-6. This request was denied by the Planning Board <br />5-0, as the surrounding land use is single-family residential in <br />character, and no multi-family development exists nearby. <br /> <br /> No one spoke either for or against Petition 84-28. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby <br />and unanimously carried, the Board denied Petition 84-28 by Lynn H. <br />Dagenhart for rezoning of property on Kansas Street at Dakota Street. <br /> <br />(6) <br /> <br />Petition 84-29. Poplar Tent Presbyterian Church, township 2, Poplar <br />Tent Road at Woodhaven Road, Map/PIN 4690-65-0511. Wishes to rezone <br />from 1-2 and C-3 to ARR. The church had originally requested C-3 <br />rezoning for the 1-2 portion of their property to conform with the <br />remaining (C-3) church property. The Planning Board voted unanimously <br />to recommend that the church's property in entirety be rezoned to <br />ARR. This would be in keeping with the rural flavor of the surrounding <br />area, and protect Poplar Tent Road from strip commercial development. <br />The church agreed with this change to ARR. <br /> <br /> Mr. Cline stated that the rezoning to ARR as recommended by the <br />Planning Board was approved by the Session of Poplar Tent Presbyterian <br />Church. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />and unanimously carried, the Board approved Petition 84-29 by Poplar <br />Tent Presbyterian to rezone property on Poplar Tent Road at Woodhaven <br />Road, Map/PIN 4690-65-0511, from I-2 and C-3 to ARR. <br /> Commissioner Payne stated in his opinion the property belonging to <br />Poplar Tent Church was incorrectly zoned at the time of the adoption of <br />the Zoning Ordinance and Atlas. He proposed that the Board consider <br />refunding the rezoning application fee to the church, but stated he would <br />not vote in the matter. <br /> Motion was made by Commissioner Barnhardt, seconded by Chairman <br />Lentz to refund the application expense to Poplar Tent Presbyterian Church <br />due to an error by the County at the time of the initial adoption of <br />the Zoning Atlas. Commissioner Barnhardt and Chairman Lentz voted for <br />the motion, Commissioner Payne abstained from voting, and Commissioners <br />Upright and Hamby voted against the motion. Chairman Lentz stated that <br />the motion was denied. <br /> <br />(7) <br /> <br />Petition 84-30. Jeter L. Lee, Jr. and Robie L. Alexander, township 4, <br />Centergrove Road at Peach Street, Map/PIN 5613(16)-94-1429, 1452. <br />Wishes to rezone from R-7.2 to 0-I. The Planning Board voted unanimously <br />to approve this request to 0-I, as the property would adjoin an 0-I <br />zoning district. <br /> <br /> Mr. Jeter L. Lee,~ Jr., property owner, and Mrs. Mildred Fisher, <br />realtor representing Ms. Robie L. Alexander, spoke in favor of the rezoning <br />to allow the establishment of offices on the property. <br /> No one spoke in opposition to the rezoning request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br />and unanimously carried, the Board approved Petition 84-30 by Jeter L. Lee, <br />Jr., and Robie L. Alexander to rezone property on Centergrove Road at <br />Peach Streeb~, Map/PIN 5613(16)-94-1429, 1452, from R-7.2 to O-I. <br /> <br /> <br />
