143 <br /> <br />(8) <br /> <br />Petition 84-31] J. W. Phillips, E. C. Kennerly, and Martha G. <br />Kennerly, township 4, West "C" Street near Dale Avenue, Map/PIN <br />5614(18)-21-8937, 9877, 7890, 5614(18)-31-0861. Wishes to rezone <br />from C-1 and RMF-6 to C-3. The Planning Board voted 4-1 to deny <br />the request for C-3 fearing the impact of heavy commercial zoning <br />in a primarily residential district. The Board voted 4-1, however, <br />to recommend rezoning to C-2 to accommodate the proposed uses for <br />the property. <br /> <br /> Mr. Philip R. Lippard, realtor, spoke in support of the rezoning <br />petition, stating the main purpose of the'C-3 zoning request was to <br />allow the establishment of a dress shop and to bring existing commercial uses <br />into conformance. He stated that the C-2 zoning as recommended by the <br />Planning Board would be acceptable as it would allow the establishment <br />of a dress shop. However, it was noted that the existing Phillips Electric <br />Company is a nonconforming use in the present C-1 zone and would continue <br />to be a nonconforming use in a C-2 district. The property would have to <br />be zoned C-3 for that business to be a conforming use. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />with Commissioners Upright and Barnhardt and Chairman Lentz voting for <br />and Commissioners Payne and Hamby voting against, the Board approved <br />Petition 84-31 by J. W. Phillips, E. C. Kennerly, and Martha G. Kennerly <br />to rezone property on West "C" Street, Map/PIN 5614(18)-21-8937, 9877, <br />7890, 5614(18)-31-0861, from C-1 and RMF-6 to C-3. <br /> <br />(9) <br /> <br />Petition 84-32. Vision Cable of Metrolina, township 4, Kansas Street <br />at Pennsylvania Avenue, Map/PIN 5622(05)-19-1545. Wishes to rezone <br />from R-9 to C-3/PDO. This request was unanimously approved by the <br />Planning Board. Although the area is totally residential in <br />character, this development would have few adverse effects to the <br />surrounding area. <br /> <br /> Mr. Robert Melton, General Manager of Vision Cable of Metrolina, <br />requested the rezoning to build a new office facility for the company at <br />that site. <br /> No one spoke in opposition to the rezoning request. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br />Upright and unanimously carried, the Board approved Petition 84-32 by <br />Vision Cable of Metrolina to rezone property on Kansas Street, Map/PIN <br />5622(05)-19-1545 from R-9 to C-3/PDO. <br /> <br />(10) Petition 84-33. Withdrawn <br /> <br />(11) Petition 84-34. Bernard Hileman, township 5, Brantley Road at 1-85, <br /> Map/PIN 5633-28-7314. Wishes to rezone from R-30 to C-4. This <br /> request was denied 5-0 by the Board fearing it would not meet the <br /> intent of the zoning ordinance regarding C-4 and may constitute <br /> spot zoning. <br /> <br /> Mr. Bob Willard, speaking on behalf of Mr. Bernard Hileman, requested <br />rezoning of the property to allow the erection of an advertising sign for <br />a restaurant in Concord. He stated that the tract of land was unsuitable' <br />for any other purpose and that an advertising sign on the site would <br />attract interstate traffic into the area. In addition, he suggested <br />that the Board consider the possibility of making outdoor signs a <br />conditional use in some areas of the county. <br /> Mr. Michael Willard, representing Horizon Outdoor Advertising, <br />cited the need for additional areas on the interstate zoned to allow <br />advertising signs. He stated that a number of businesses in the area <br />were interested in advertising signs and that the signs would not only <br />provide money to the property owner but would attract people on the <br />interstate into the area. <br /> No one spoke in opposition to Petition 84-34. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne <br />with Commissioners Hamby, Payne, and Barnhardt and Chairman Lentz voting <br />for and Commissioner Upright voting against, the Board denied Petition 84-34 <br />by Bernard Hileman to rezone property on Brantley Road at 1-85, Map/PIN <br />5633-28-7314, from R-30 to C-4. <br /> <br /> <br />
