150 <br /> <br /> The Board received the letter of resignation from Mr. E. K. Prewitt, <br />Jr., as a member of the Cabarrus County Library Board of Trustees and <br />the recommendation by Mr. Branson Jones, Chairman of the Library Board of <br />Trustees, for the appointment of Mr. Henry H. Land to fill this vacancy. <br />After determining that Mr. Land was a resident of Kannapolis, the Board <br />requested that a resident of Concord be recommended to fill Mr. Prewitt's <br />position in order to maintain the geographical representation established <br />at the time of the appointment of the Board of Trustees. <br /> B. S. Brown,~Jr., representing the Kannapolis Sanitary District, <br />presented the following resolution which was read: <br /> <br />RESOLUTION RELATING TO THE ANNEXATION OF <br />TERRITORY TO KANNAPOLIS SANITARY DISTRICT <br /> <br />BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF CABARRUS: <br /> <br /> Section 1. That the Board of Commissioners for the County of Cabarrus <br />has determined and does hereby find and declare: <br /> <br /> (a) That on January 21, 1985, a resolution was received from the <br />Sanitary District Board of the Kannapolis Sanitary District relating to <br />the annexation of territory to the Kannapolis Sanitary District. <br /> (b) That the territory described in the petition consists of the <br />property of Richard E. Armstrong and wife, Sherran L. Armstrong. <br /> (c) That the petition was signed by all property owners within the <br />area requested to be annexed. <br /> (d) That said petition requests that all necessary action required <br />by Article 12 of Chapter 130 of the General Statutes of North Carolina <br />for the extension of the boundaries of the Kannapolis Sanitary District <br />be taken so as to annex the territory described in the petition unto the <br />Kannapolis Sanitary District. <br /> (e) That it is for the best interest of the Kannapolis Sanitary <br />District and the territory requested to be annexed unto the Kannapolis <br />Sanitary District that said territory be included within the boundaries <br />of the Kannapolis Sanitary District and receive the services of the <br />Sanitary District. <br /> <br /> Section 2. That the Board of Commissioners for the County of Cabarrus <br />does hereby approve the annexation of the territory described in the petition <br />unto the Kannapolis Sanitary District and does hereby recommend to the <br />North Carolina Commission for Health Services that it approve the annexation <br />of the territory unto the Kannapolis Sanitary District. <br /> <br /> Section 3. That the Clerk of the Board of Commissioners for the <br />County of Cabarrus is hereby directed to certify a copy of this resolution <br />to the Director, Division for Health Services, Department of Human Resources, <br />State of North Carolina. <br /> <br /> Thereupon, upon motion of Commissioner Upright, seconded by Commissioner <br />Barnhardt, the foregoing resolution entitled: "RESOLUTION RELATING TO THE <br />ANNEXATION OF TERRITORY TO KANNAPOLIS SANITARY DISTRICT" was passed by the <br />following vote: <br /> <br />Ayes: <br />Noes: <br /> <br />Chairman Lentz and Commissioners Payne, Hamby, Barnhardt, <br />and Upright <br />None <br /> <br /> The boundaries of the Armstrong property petitioned to be annexed to <br />and included in the Kannapolis Sanitary District are as follows: <br /> <br />BEGINNING at a point in the Kannapolis Sanitary District's <br />boundary line where the dividing line between Lots Nos. 86 <br />and 87 of Elmwood Park, Section II, intersects said boundary <br />line, this beginning point being 925 feet, more or less, in <br />an easterly direction from the point where the boundary line <br />of the Kannapolis Sanitary District intersects the center <br />line of Cooper Avenue, and runs thence with the dividing <br />line between Lots Nos. 86 and 87 of Elmwood Park, Section II, <br />North 34-05 West 157 feet to a point in the center line of <br /> <br /> <br />
