180 <br /> <br /> Mr. Lester Biggerstaff presented a petition signed by 40 homeowners <br />of the area stating opposition to the rezoning petition and asking that <br />the area remain zoned residential. He expressed concern regarding the <br />numerous accidents on the curve at the property and at the intersection <br />of Bethpage Road and Mooresville Road. <br /> Mr. Wade Hammonds reviewed his plans to build a restaurant on the <br />property with an antique store and home to be added at a later date. He <br />also stated his intent to bring the lot down to road level and improve <br />traffic conditions in the area. In conclusion, he expressed the need <br />for a restaurant in that section of the county. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board denied Petition 85-02 by Mr. Wade <br />Hammonds to rezone property on Mooresville Road at Bethpage Road from <br />R-9toC-2. <br /> <br />(3) <br /> <br />Petition 85-03. James P. Morrison, Jr., township 11, Old Charlotte <br />Road at White Avenue, Map/PIN 5529(14)-34-7449. Wishes to rezone <br />from R-9 to C-3. The Planning Board denied this request 5 to 0 <br />fearing detrimental effects to the nearby residential area. <br /> <br /> Mr. William L. Mills, III, attorney representing Mr. James P. <br />Morrison, Jr., requested the rezoning to allow the establishment of a <br />car sales lot for the purchasing and resale of "classic automobiles". <br />Mr. Mills noted that the junk yard located in one section of the property <br />was not connected with the operation planned by Mr. Morrison. In conclusion, <br />Mr. Mills stated that Mr. Morrison would accept a C-2 or C-4 zoning <br />classification along with a Planned Development Overlay (PDO) for the <br />property. <br />Ms. Evelyn Carson, adjacent property owner, opposed the rezoning, <br />stating that she did not want a used car lot in the residential neighborhood. <br /> Mr. Randy McBroom, relative of Ms. Evelyn Carson, also stated opposition <br />to the requested rezoning of the property and the establishment of a car <br />sales lot in the residential community. He expressed concern about future <br />uses of the property if it were sold by Mr. Morrison at a later date. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />with Commissioners Barnhardt and Payne and Chairman Lentz voting for and <br />Commissioners Hamby and Upright voting against, the Board changed the <br />request from C-3 to C-2 and approved the petition by Mr. James P. Morrison, <br />Jr., rezoning the property on Old Charlotte Road at White Avenue, <br />Map/PIN 5529(14)-34-7449 from R-9 to C-2. <br /> <br />(4) <br /> <br />Petition 85-04. Ellare D. Johnson, township 4, Wood Street near <br />James Street, Map/PIN 5613(12)-86-7995. Wishes to rezone from R-7.2 <br />to R-8. This request was approved unanimously by the Planning Board. <br />The Board felt the approval of this request would not have a detrimental <br />effect on the neighborhood. <br /> <br /> The daughter of Ms. Ellare D. Johnson requested approval of the petition <br />to allow her mother to place a mobile home on the property. No one spoke <br />in opposition to the rezoning petition. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 85-04 by Ellare D. <br />Johnson to rezone property on Wood Street near James Street, Map/PIN 5613(12)- <br />86-7995 from R-7.2 to R-8. <br /> <br />(5) <br /> <br />Petition 85-05. Charlie Sehorn, township 5, Highway 73 and Kirkwood <br />DriVe. Map/PIN 5640(07)-89-1509. Wishes to rezone from ARR to O-I. <br />The Planning Board denied this request 5 to 0 fearing encroachment <br />on the surrounding residential area. <br /> <br /> Mr. William G. Alexander, attorney representing Phil Cline Trucking <br />Company, requested the rezoning to allow the construction of an office for <br />the trucking company, which presently operates as a non-conforming use <br />down the road on Kirkwood Drive. He presented an amendment to the rezoning <br />application to leave a strip of land 25 feet wide bordering the western and <br />northern boundary lines of the property zoned as ARR to serve as a buffer <br />area and screen adjacent to the surrounding ARR property.
