184 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in adjourned <br />session in the Superior Courtroom of the County Courthouse in Concord, <br />North Carolina, on Monday, March 11, 1985, at 7:00 P.M. to continue <br />the public hearing on proposed Zoning Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. Gordon L. Belo, attorney, served as legal counsel in the absence <br />of Mr. Fletcher L. Hartsell, Jr., County Attorney. <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Ms. Debra Luckadoo-Shockley, member of the Cabarrus County Planning <br />staff, reviewed the location of the areas proposed for rezoning. Public <br />input was received by the Board prior to action regarding each of the <br />proposed amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(6) <br /> <br />Petition 85-06. Jerry D. and Shirley F. Morgan, township 4, Eddleman <br />Road near Cannon Boulevard, Map/PIN 5623(17)-00-1525. Wishes to <br />rezone from R-9 to C-3. This request was denied 5 to 0 by the Planning <br />Board fearing extension of the commercial district would harm the <br />surrounding residential district. <br /> <br /> Mr. Jerry D. Morgan requested the rezoning to allow an outlet on <br />Eddleman Road for his used car lot located on Cannon Boulevard. He <br />stated plans to build a car cleaning operation in the backyard of the <br />property and to convert the existing house into office space. No one spoke in opposition to the rezoning request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />with Commissioners Upright, Barnhardt, and Hamby and Chairman Lentz voting <br />for and Commissioner Payne voting against, the Board approved Petition 85-06 <br />by Jerry D. and Shirley F. Morgan to rezone property on Eddleman Road near <br />Cannon Boulevard, Map/PIN 5623(17)-00-1525 from R-9 to C-3. <br /> <br />(7) <br /> <br />Petition 85-07. Robert R. Nelson, township 2, southside of Untz Road, <br />Map/PIN 4691-43-5084, 3112. Wishes to rezone from ARR to RMF-7. <br />The Planning Board denied this request 4 to 1 feeling this area was <br />not suitable for multi-family due to concerns over the water/sewer <br />services. <br /> <br /> Mr. James E. Scarbrough, attorney representing Mr. Robert R. Nelson, <br />requested the rezoning, stating it was Mr. Nelson's intent to upgrade <br />the existing 18-unit mobile home park under provisions of current mobile <br />home park standards and develop a 42-unit park. He stated the improvements <br />would include a state approved water system and waste treatment plant, <br />paved roads, recreational area, and landscaping~ Mr. Scarbrough noted that <br />Mr. Nelson would be willing to accept a Planned Development Overlay (PDO) <br />for the property. In conclusion, Mr. Scarbrough stated in his opinion <br />the Board should allow the upgrading of existing mobile home parks rather <br />than the establishment of new parks in the county. <br /> Mr. Robert Nelson, property owner, stated that the planned improvements <br />to the park would have a favorable impact on the property values in that <br />neighborhood. <br /> Mr. Tommy Fisher, resident of Untz Road, presented a petition containing <br />the signatures of 17 families of Untz Road who were opposed to the rezoning. <br />He expressed concern regarding the future of the neighborhood and the <br />possible expansion of the mobile home park if additional land became <br />available. <br /> Mr. Harper Hiner, resident of Untz Road, objected to the rezoning <br />and stated the addition of more mobile homes would destroy the nice <br />park that now exists. <br /> Ms. Debra Waddell, resident of the existing Coddle Creek Mobile Home <br />Park and representative of all families living there, spoke in favor of the <br />rezoning. She asked that Mr. Nelson be allowed to make the planned <br />improvements to help the current residents. <br /> <br /> <br />
