187 <br /> <br /> Mr. Alex Rankin of Concord Engineering & Surveying, Inc., reviewed <br />plans to provide sewer service through the main outfall line on the <br />property. He stated that a temporary community water system would be <br />developed to serve the mobile home park until the County water became <br />available. <br />Mr. R. G. Faggart, Jr., petitioner, spoke in support of the rezoning. <br />Mr. Joe Ridenhour, member of the Cabarrus County Planning Board, <br />stated he was now in favor of the rezoning although he had voted against <br />the matter at the Planning Board meeting. He indicated there were few <br />available sites in the county for the development of a mobile home park. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />with Commissioners Payne, Barnhardt, and Upright voting for and <br />Chairman Lentz and Commissioner Hamby voting against, the Board approved <br />Petition 85-13 by Robert G. Faggart, Jr., to rezone property on Fairbluff <br />Road off Highway 601, Map/PIN 5548-35-9368, from ARR to R-7.2. <br /> <br />(14) Petition 85-14. Withdrawn <br /> <br />(15) Petition 85-15. Ben Pigg, township 4, Biscayne Drive off Highway 73 W, <br /> Map/PIN 5601-36-0205. Wishes to rezone from A-I to I-1. The <br /> Planning Board approved this petition 5 to 0 feeling it was a good <br /> location for industrial development and an I-1 zone exists nearby. <br /> <br /> Mr. John Evans, Operations Manager for Alpha and Omega Transport in <br />Charlotte, requested approval of the rezoning to permit the establishment <br />of a trucking firm at this site. <br /> No one spoke in opposition to the rezoning. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 85-15 by Ben Pigg <br />to rezone property on Biscayne Drive off Highway 73 W, Map/PIN 5601-36-0205, <br />from A-I to I-1. <br /> <br />(17) Petition 85-17. Cannon Mills Realty and Development Corporation, <br /> township 4, South Main Street and West "D" Street, Map/PIN 5613(07)- <br /> 58-4320. The Planning Board approved this request feeling the rezoning <br /> would tie in with ongoing redevelopment plans for downtown Kannapolis. <br /> <br /> It was noted that this petition included the entire block at South <br />Main Street and West "D" Street. No one spoke either for or against the <br />rezoning petition. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br />and unanimously carried, the Board approved Petition 85-17 by Cannon <br />Mills Realty and Development to rezone the property at South Main Street <br />and West "D" Street, Map/PIN 5613(07)-58-4320, from R-7.2 to C-2. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(1) Petition 85-01. Amend Section 16 Definitions, page 122 to include: <br /> <br />Extraction of Earth Products - shall be all mining activities as <br />defined in G.S. 74-49, in particular subsections 6 and 7 as follows: <br /> <br />74-49 Definitions. <br /> <br /> Wherever used or referred to in this Article, unless a different <br />meaning clearly appears from the context: <br /> <br />(1) "Affected land" means the surface area of land that is mined, the <br /> surface area of land on which overburden and waste is deposited, <br /> and the surface area of land used for processing or treatment <br /> plant, stockpiles, and settling ponds. <br />(2) "Borrow pit" means an area from which soil or other unconsolidated <br /> materials are removed to be used, without further processing, for <br /> highway construction and maintenance. <br />(3) "Commission" means the Mining Commission created by G.S. 143B-290. <br />(4) "Department" means the Department of Natural Resources and Community <br /> Development. Whenever in this Article the Department is assigned <br /> duties, they may be performed by the Secretary or by such of his <br /> subordinates as he may designate. <br /> <br /> <br />
