202 <br /> <br />SEWER RIGHT OF WAY <br /> <br />STATE OF NORTH CAROLINA, ) <br />CABARRUS COUNTY. ) <br /> <br /> Know all men by these presents, that I/we CABARRUS COUNTY of the <br />County of Cabarrus, State of North Carolina, in consideration of the <br />premises and the sum of $1.00 o.v.c, in hand paid by the Board of Light <br />and Water Commissioners, Concord, N.C., the receipt whereof is hereby <br />acknowledged does hereby grant unto the Board of Light and Water <br />Commissioners, its successors and assigns, the right, privilege and <br />easement to go in and upon the following property: <br /> <br />THIS RIGHT OF WAY SUPERSEDES THE SEWER RIGHT OF WAY RECORDED IN DEED <br /> <br />BOOK 587~ PAGE 83: <br /> <br />Lying and being in Number 11 Township, Cabarrus County, North Carolina, <br />adjoining the property of Pearl H. Wensil and others, and being a strip <br />of land thirty feet in width, the left boundary being 15 feet from and <br />parallel with and the right boundary being 15 feet from and parallel <br />with the following described center lines: <br />TRACT 1: <br />BEGINNING at a point in the property line of Pearl H. Wensil (said point <br />being S.85-37-37 E., 67.97 feet from an existing iron pipe, corner of <br />Pearl H. Wensil and Cabarrus County Home) and runs thence: N. 28-14-46 E., <br />25.96 feet to a proposed manhole (Sta. 3+44.68); thence: N. 86-21-04 W., <br />89.01 feet; thence: N. 7-34-13 E., 339.13 feet to an existing manhole <br />on the sewer line running to Cabarrus County Health Department. <br />TRACT 2: <br />BEGINNING at proposed manhole Sta. 3+ 44.68 and runs thence: S. 88-21-11 E., <br />90 feet (+-) to a point in the right of way line of Palmer Street. <br /> <br />TOGETHER WITH A CONSTRUCTION EASEMENT ten feet in width adjoining the <br />aforesaid right of way lying on the left and right side of said right of <br />way. <br />Said construction easement and permanent easement being granted to the <br />extent said easements lie within the bounds of the grantor's property. <br /> <br />See plat prepared by Concord Engineering and Surveying, Inc., copy of which <br />is attached hereto. <br /> <br /> And to construct and maintain in, upon and through said premises in <br />a proper manner with all necessary pipes, a sewer line, together with the <br />right at all times to enter upon said premises for the purpose of inspecting <br />said sewer line, and making all necessary repairs and alterations thereon <br />by hauling with necessary conveyances, materials for said purposes; together <br />with the right to cut away and keep clear of said sewer line all trees and <br />other obstructions that may in any way endanger or hinder the proper <br />operation of the same. <br /> <br /> IN WITNESS WHEREOF the said Chairman of the Cbarrus County Board of <br />Commissioners has/have hereunto set their hand(s) and seal(s) on this <br />1st day of April, 1985. <br /> <br />CABARRUS COUNTY <br /> <br />Attest: /s/ Frankie F.
