214 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Thursday, May 2, 1985, in the Superior Courtroom of the Cabarrus County <br />Courthouse in Concord, North Carolina, for a public hearing regarding <br />proposed Zoning Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Ms. Debra Luckadoo-Shockley, member of the Cabarrus County Planning <br />staff, reviewed the location of the areas proposed for rezoning. Public <br />input was received by the Board prior to action regarding each of the <br />proposed amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 85-18. Joe M. Stallings Estate, township 1, Pharr Mill Road <br />and Shamrock Road, Map/PIN 5517-77-0004. Wishes to rezone from I-2 <br />to ARR. This request was approved by the Planning Board 3-2 to allow <br />residential development, and to protect existing residences from <br />further industrial development. <br /> <br /> Mr. F. A. Rankin, Chairman of the Planning Board, reported that the <br />Petition had been unanimously~approved by the Planning Board. <br /> Mr. James F. Owens, Assistant Planning Director, expressed concern <br />regarding the proximity of Mineral Research and Development Corporation to <br />the Stallings property. He reviewed the I-2 District Statement of Intent <br />and those provisions of the North Carolina Hazardous Waste Management Rules <br />that pertain to the' operation of Mineral Research and Development Corporation. <br />In conclusion, Mr. Owens proposed that the 3.69-acre section of the property <br />located on the north side of Rocky River remain zoned I-2 with the river <br />serving as the natural break between the ARR and I-2 districts. <br /> Mr. James E. Scarbrough, attorney representing Mr. Joe M. Stallings, <br />requested the rezoning of all the Stallings property from I-2 to ARR. He <br />stated it was the intent to use the 3.69 acre tract located on the north <br />side of Rocky River as a buffer area. Mr. Scarbrough further proposed <br />the possibilities of a Planned Development Overlay District (PDO) for the <br />3.69-acre tract or the sale of that tract of land to Mineral Research and <br />Development Corporation with deed restrictions prohibiting the use of the <br />property for industrial purposes. <br /> Mr. Charles Davis, speaking on behalf of Mineral Research and Development <br />Corporation, presented information regarding the operations of that company. <br />He also supported the use of the 3.69-acre tract as a buffer area, but he <br />asked that the property remain zoned I-2. Mr. Davis further stated that <br />company's willingness to negotiate with Mr. Stallings regarding the purchase <br />of this tract of land at a fair amount. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />and unanimously carried, the Board agreed to rezone the Joe M. Stallings <br />Estate property located on the south side of Rocky River from I-2 to ARR and <br />deferred action until the next meeting on the 3.69 acres located on the <br />north side of Rocky River. <br /> <br />(2) <br /> <br />Petition 85-19. Cannon Mills Realty and Development Corporation, <br />township 4, South Main Street and East "C" Street, Map/PIN 5613(07)- <br />58-9773, 7220, 6192, 8308, 7371. Wishes to rezone from R-7.2 to <br />C-2. This request was unanimously approved by the Planning Board, <br />as it would be compatible with the surrounding commercial development. <br /> <br /> There was no one present to speak either for or against this rezoning <br />petition. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 85-19 by Cannon Mills <br />Realty and Development Corporation to rezone property in township 4, <br />Map/PIN 5613(07)-58-9773, 7220, 6192, 8308, 7371, from R-7.2 to C-2. <br /> <br /> <br />
