<br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M.
<br />on Tuesday, July 9, 1985, in the Superior Courtroom of the Cabarrus County
<br />Courthouse in Concord, North Carolina, for a public hearing regarding
<br />proposed Zoning Atlas and Text Amendments. This meeting had been rescheduled
<br />from Thursday, July 4, 1985.

<br /> Marcelle M.~Upright
<br /> Commissioner Payne, liaison to the Cabarrus County Health Board,
<br />reported that it had been determined that there.would be no conflict with
<br />Cabarrus Memorial Hospital in awarding the bid for the mobile health unit
<br />for the Health Department. This bid award had been deferred on July 8, 1985,
<br />until contact could be made with Mr. Robert Wall, Cabarrus Memorial Hospital
<br />Director.
<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and
<br />unanimously carried, the Board awarded the bid for the purchase of a
<br />mobile health unit for the Cabarrus County Health Department to Medical
<br />Coaches Incorporated in the amount of $83,366.00.
<br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board,
<br />presented each of the proposed amendments as recommended by the Planning
<br />Board. Mr. James F. Owens, Assistant Planning Director, reviewed the
<br />location of the areas proposed for rezoning. Public input was received
<br />by the Board prior to action regarding each of the proposed amendments.

<br />ZONING ATLAS AMENDMENTS

<br />Petition 85-23. Harold L. Mills and Mrs. (William) Ruby Mills,
<br />biadison Avenue, township 4, Map/PIN 5613(17)-02-7162, 02-7234.
<br />Wishes to rezone from R-9 to RMF-6. 4-0 approval, Planning Board
<br />felt this rezoning would be compatible with the current land use
<br />in the immediate vicinity.
<br />
<br /> Ms. Sarah Coggins, Madison Avenue resident, objected to the rezoning
<br /> petition, stating that additional apartments on the street would increase
<br /> traffic in the area.
<br /> Ms. Sammie Long, resident living on the corner of Madison Avenue and
<br /> Rogers Lake Road, opposed the construction of any additional multi-family
<br /> housing on Madison Avenue. She complained of the noise created by the
<br /> traffic traveling to and from the existing apartments.
<br /> Mr. William L. Mills, III, attorney for the petitioners, spoke in
<br /> support of the rezoning. He stated future plans for the property included
<br /> the sale of the units as single family residences.
<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
<br /> and unanimously carried, the Board approved Petition 85-23 by Harold L.
<br /> Mills and Mrs. Ruby Mills to rezone property on Madison Avenue, Map/PIN
<br />5613(17)-02-7162, 02-7234, from R-9 to RMF-6.

<br />Petition 85-24. Allen R. McLellan, Pine Circle-Drive, township 4,
<br />Map/PIN 5611(11)-64-6959, 65-6165, 65-7582. Wishes to rezone from
<br />R-30 to C-3. 4-0 approval, Planning Board felt with this being
<br />rezoned no problem should exist with proper screening.
<br />
<br /> Mr. James F. Owens reported that the stated purpose of the rezoning
<br />petition was to bring an existing salvage yard into compliance with the
<br />Zoning Ordinance in order to operate the facility as a garage. He stated
<br />that the property had been rezoned in March, 1983, from I-2 to R-30 and
<br />that it was the staff's recommendation that the property be left as R-30.
<br />Mr. Owens further stated that in the opinion of the staff the property
<br />should have been zoned as a non-conforming use from the onset of zoning
<br />since the principal use of the surrounding properties is commercial. In
<br />conclusion, he pointed out that the rezoning would create a spot of
<br />commercial usage which could be reflected as spot zoning.
<br /> No one spoke either for or against the rezoning petition.
<br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Upright
<br />with Commissioners Barnhardt and Upright and Chairman Lentz voting for and
<br />Commissioners Payne and Hamby voting against, the Board approved Petition
<br />85-24 by Allen McLellan to rezone property on Pine Circle Drive, Map/PIN
<br />5611(11)-64-6959, 65-6165, 65-7582, from R-30 to C-3.
