272 <br /> <br />(3) <br /> <br />Petition 85-25. Bruce L. Woodard, Fairview Street and McLain Road, <br />township 4, Map/PIN 5623(09)-16-2194. Wishes to rezone from RMF-7 <br />to C-3. 2-2 vote, Board had some apprehension due to the fact <br />a great deal of commercial exist in the area undeveloped. <br /> <br /> It was noted that it was the Planning staff's recommendation to deny <br />the request on the grounds that too much undeveloped commercial property <br />exist in the Kannapolis area and that existing commercial zones should be <br />upgraded prior to the expansion of the commercial zones. <br /> Mr. Bruce Woodard, property owner, spoke in support of the rezoning <br />to permit him to add on to an existing shop on the property. No one spoke <br />in opposition to the petition. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Upright <br />and unanimously carried, the Board approved Petition 85-25 by Bruce L. <br />Woodard to rezone property on Fairview Street and McLain Road, Map/PIN <br />5623(09)-16-2194, from RMF-7 to C-3. <br /> <br />(4) Petition 85-26. Ronald E. Lawing, "J'" Street and Broad Street, <br /> township 4, Map/PIN 5613(10)-36-6675, 36-7526. Wishes to rezone <br /> from RMF-6 to R-8. 4-0 denied, due to encroachment on multi-family <br /> zone. <br /> <br /> Mr. Ronald Lawing, property owner, requested the rezoning to allow the <br />replacement of a mobile home at the site where one was located approximately <br />two years ago. He stated the neighbors on the street were in favor of the <br />mobile home at the site. His father also spoke in support of the rezoning. <br />He questioned the zoning on Broad Street which he stated currently differs <br />from one side of the street to the other. <br /> Mr. James F. Owens reported that approval of this rezoning would create <br />a spot zone. He stated the loop road is planned to come within close <br />proximity to the subject property and it was the staff's recommendation <br />that the petition be denied until a more detailed plan can be worked up <br />for the area. <br /> No one spoke against the rezoning request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />with Commissioners Barnhardt, Upright, and Hamby voting for and Commissioner <br />Payne and Chairman Lentz voting against, the Board approved Petition 85-26 <br />by Ronald E. Lawing to rezone property on "J" Street and Broad Street, <br />Map/PIN 5613(10)-36-6675, 36-7526, from RMF-6 to R-8. <br /> <br />(5) <br /> <br />Petition 85-27. James H. Isenhour, Isenhour Road, township 4, <br />Map/PIN 5602-69-9069. Wishes to rezone from R-40 to R-30. 4-0 approval, <br />keeping in character with existing land use. <br /> <br /> The father-in-law of Mr. James H. Isenhour, property owner, asked for <br />the rezoning to permit Mr. Isenhour to place a mobile home on a one-acre <br />tract that was cut from a 50-acre tract of land owned by Mr. Isenhour's <br />family. <br /> Mr. James F. Owens advised the Board that the request if granted would <br />create a spot zone. <br /> Mr. F. A. Rankin, Planning Board Chairman, stated in his opinion the <br />property should not have been zoned R-40 at the time of the adoption of the <br />Zoning Ordinance. <br /> The motion by Commissioner Payne to deny Petition 85-27 failed for <br />lack of second. <br /> The motion by Commissioner Payne and seconded by Commissioner Hamby to <br />table Petition 85-27 until the next zoning meeting at which time the Planning <br />staff will have contacted the owners of the property to determine if they would <br />agree to rezoning all the property to R-30 failed with Commissioners Payne <br />and Hamby voting for and Chairman Lentz and Commissioners Upright and <br />Barnhardt voting against. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Upright <br />with Commissioners Barnhardt and Upright and Chairman Lentz voting for and <br />Commissioners Hamby and Payne voting against, the Board approved Petition <br />85-27 by James H.'Isenhour to rezone property on Isenhour Road, Map/PIN <br />5602-69-9069, from R-40 to R-30. The metes and bounds description of <br />this property as drawn by Charles D. Brown is as follows. <br /> <br /> <br />
