277 <br /> <br />(6) <br /> <br />Petition 85-39. James Daily, Jr., township 6, Pless Road, Map/PIN <br />5653-48-1194. Wishes to rezone from A-2 to I-1. Planning Board <br />voted to approve 3-0, felt that due to the sparsely populated area, <br />this type of business would have no adverse affect on surrounding <br />properties. <br /> <br /> Mr. Richard Daily spoke in support of the rezoning to permit the <br />expansion of the existing vitamin business. <br /> Mr. James F. Owens,' Assistant Planning Director, advised the Board that <br />the granting of this request would constitute spot zoning with the surrounding <br />property being sparsely populated farmland with an I-X zone approximately <br />one-fourth mile east of the property. He stated it was the Planning Staff's <br />recommendation that the rezoning request be denied. Mr. Owens explained <br />that in the opinion of the staff the A-2 zone should be changed to <br />accommodate such uses with performance zoning standards. However, he <br />noted that the County does not currently have performance zoning standards. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Upright <br />with Commissioners Barnhardt, Upright, and Hamby and Chairman Lentz voting <br />for and Commissioner Payne voting against, the Board approved Petition <br />85-39 by James Daily, Jr., to rezone property on Pless Road, Map/PIN <br />5653-48-1194, from A-2 to I-1. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />(1) Petition 85-09. Amend Section 3.2-4, Schedule of Use Regulations, <br /> line item Barber and Beauty Shops: <br /> <br />From: <br /> <br />A non-permitted use in the O-I district <br />Barber and Beauty Shops O-I <br /> <br />To: <br /> <br />A permitted use in the O-I district <br />Barber and Beauty Shops O-I <br /> P <br /> <br />The Planning Board voted 3-0 in favor of this text amendment, feeling <br />that Barber and Beauty Shops serve as personal care services and do <br />not really serve as retail uses. The Planning Board and Planning Staff <br />viewed this as a practical solution since barbers and beauticians are <br />licensed by the State of North Carolina. <br /> <br />There was no present to speak for or against the proposed amendment. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved Petition 85-09 to amend Section <br />3.2-4, Schedule of Use Regulations, to show the line item Beauty and <br />Barber Shops as a permitted use in the O-I district as follows. <br /> <br />Barber and Beauty Shops O-I <br /> P <br /> <br /> Mr. James F. Owens, Assistant Planning Director, presented the letter <br />dated July 19, 1985 from Joe M. Stallings formally withdrawing his request <br />for the rezoning application of the 3.69 acre tract which is part of the <br />River Hills Estates. This rezoning request had been tabled by the Board <br />in May, 1985. <br /> Mr. James F. Owens, Assistant Planning Director, advised the <br />Board that there would be approximately five zoning petitions for <br />consideration by the Board next month. Chairman Lentz stated that <br />the Board would meet for a zoning public hearing on September 5, 1985, <br />to consider these petitions. <br /> The-Board discussed zoning regulations for the City of Kannapolis and <br />the estimated two years for the formulation of a Zoning Ordinance for <br />the City. Mr. James F. Owens suggested the possibility of the Board of <br />Commissioners and the County Planning Board meeting with the Kannapolis <br />Planning Board to consider rezoning requests within the City.
