294 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the <br />County Courthouse in Concord, North Carolina, on Thursday, September 5, <br />1985, at 7:00 P.M. for a public hearing regarding proposed Zoning Atlas <br />and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. Steve Medlin of the Medlin & Medlin Law Firm reported that his <br />firm had been retained by the Flowes Store'Volunteer Fire Department <br />to study the by-laws, °minutes, and organizational structure of the fire <br />department. He stated they were currently searching for all past records <br />and were working to develop a good written system for the future operation <br />of the department. <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the Cabarrus County Planning staff, <br />reviewed the location of the areas proposed for rezoning. Public input <br />was received by the Board prior to action regarding each of the proposed <br />amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(i) <br /> <br />Petition 85-37. Bradford and Cynthia Ballard, township 4, South <br />Ridge Avenue and Plymouth Street, Map PIN 5613(15)-64-1512. Wishes <br />to rezone from R-7.2 to C-1 or O-I. Planning Board voted 3-0 to <br />deny, felt it was an encroachment on the neighborhood. This rezoning <br />was tabled at the public hearing on August 1, 1985. <br /> <br />(2) <br /> <br />Petition 85-38. Ms. Mabry Grant, township 4, South Ridge Avenue, <br />Map/PIN 5613(15)-64-1809, 64-0995, 5613(11)-65-0070. Wishes to <br />rezone from R-7.2 to C-1 or O-I. Planning Board voted 3-0 to deny, <br />felt it was an encroachment on the neighborhood. This rezoning was <br />tabled at the public hearing on August 1, 1985. <br /> <br /> Mr. Keith Hammonds, resident of 821 South Ridge Avenue, opposed the <br />rezoning, stating it would be an encroachment on the neighborhood. He <br />also. presented a petition by neighbors in the community Who were in <br />opposition to the rezoning. <br /> Mr. Farrar Griggs, attorney representing the petitioners, spoke in <br />support of the rezoning. He stated that the neighborhood was a mixture <br />of both residential and commercial establishments and pointed out there <br />were 10 existing businesses within 7/10 of a mile of the intersection of <br />Centergrove Road and South Ridge Avenue. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br />with Commissioners Upright, Payne, and Barnhardt and Chairman Lentz voting <br />for and Commissioner Hamby voting against, the Board denied Petition 85-37 <br />by Bradford and Cynthia Ballard to rezone property on South Ridge Avenue <br />and Plymouth Street from R-7.2 to C-1 or O-I. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />with Commissioners Upright, Barnhardt, and Payne and Chairman Lentz voting <br />for and Commissioner Hamby voting against, the Board denied Petition 85-38 <br />by Ms. Mabry Grant to rezone property on South Ridge Avenue from R-7.2 to <br />C-1 or O-I. <br /> <br />(3) <br /> <br />Petition 85-40. Mr. C. L. Mills, township 4, South Main Street, <br />Map/PIN 5613(19)-61-3055. Wishes to rezone from C-1 to C-3. Planning <br />Board voted 3-0 to approve, felt this use would conform with existing <br />land uses in the area. <br /> <br /> There was no one present to. speak either for'or against this rezoning <br />request. <br /> UPONMOTION of Commissioner Barnhardt, seconded by Commissioner <br />Upright and unanimously carried, the Board approved Petition 85-40 by <br />Mr. C. L. Mills to rezone property on South Main Street, Map/PIN 5613(19)- <br />61-3055 from C-1 to C-3. <br /> <br /> <br />
