294 The Board of Commissioners for the County of Cabarrus met at the County Courthouse in Concord, North Carolina, on Thursday, September 5, 1985, at 7:00 P.M. for a public hearing regarding proposed Zoning Atlas and Text Amendments. Present - Chairman: James W. Lentz Commissioners: Kenneth F. Payne William G. Hamby, Jr. Archie Y. Barnhardt Marcelle M. Upright Mr. Steve Medlin of the Medlin & Medlin Law Firm reported that his firm had been retained by the Flowes Store'Volunteer Fire Department to study the by-laws, °minutes, and organizational structure of the fire department. He stated they were currently searching for all past records and were working to develop a good written system for the future operation of the department. Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, presented each of the proposed amendments as recommended by the Planning Board. Mr. Michael Byrd, member of the Cabarrus County Planning staff, reviewed the location of the areas proposed for rezoning. Public input was received by the Board prior to action regarding each of the proposed amendments. ZONING ATLAS AMENDMENTS (i) Petition 85-37. Bradford and Cynthia Ballard, township 4, South Ridge Avenue and Plymouth Street, Map PIN 5613(15)-64-1512. Wishes to rezone from R-7.2 to C-1 or O-I. Planning Board voted 3-0 to deny, felt it was an encroachment on the neighborhood. This rezoning was tabled at the public hearing on August 1, 1985. (2) Petition 85-38. Ms. Mabry Grant, township 4, South Ridge Avenue, Map/PIN 5613(15)-64-1809, 64-0995, 5613(11)-65-0070. Wishes to rezone from R-7.2 to C-1 or O-I. Planning Board voted 3-0 to deny, felt it was an encroachment on the neighborhood. This rezoning was tabled at the public hearing on August 1, 1985. Mr. Keith Hammonds, resident of 821 South Ridge Avenue, opposed the rezoning, stating it would be an encroachment on the neighborhood. He also. presented a petition by neighbors in the community Who were in opposition to the rezoning. Mr. Farrar Griggs, attorney representing the petitioners, spoke in support of the rezoning. He stated that the neighborhood was a mixture of both residential and commercial establishments and pointed out there were 10 existing businesses within 7/10 of a mile of the intersection of Centergrove Road and South Ridge Avenue. UPON MOTION of Commissioner Upright, seconded by Commissioner Payne with Commissioners Upright, Payne, and Barnhardt and Chairman Lentz voting for and Commissioner Hamby voting against, the Board denied Petition 85-37 by Bradford and Cynthia Ballard to rezone property on South Ridge Avenue and Plymouth Street from R-7.2 to C-1 or O-I. UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt with Commissioners Upright, Barnhardt, and Payne and Chairman Lentz voting for and Commissioner Hamby voting against, the Board denied Petition 85-38 by Ms. Mabry Grant to rezone property on South Ridge Avenue from R-7.2 to C-1 or O-I. (3) Petition 85-40. Mr. C. L. Mills, township 4, South Main Street, Map/PIN 5613(19)-61-3055. Wishes to rezone from C-1 to C-3. Planning Board voted 3-0 to approve, felt this use would conform with existing land uses in the area. There was no one present to. speak either for'or against this rezoning request. UPONMOTION of Commissioner Barnhardt, seconded by Commissioner Upright and unanimously carried, the Board approved Petition 85-40 by Mr. C. L. Mills to rezone property on South Main Street, Map/PIN 5613(19)- 61-3055 from C-1 to C-3.
