296 <br /> <br />B. Standards of Evaluation: <br /> The following specific standards shall be used in deciding an <br />application for the approval of this class of use: <br /> <br />(1) If the property adjoins a residential district, the following <br />requirements shall be met: <br /> <br />(a) The storage facility must be located at least 120 feet <br />from the exterior property line bordering a residential <br />district. <br /> <br />(b) Vehicular access to the.site will be provided from <br />major thoroughfares, and will not require the use of minor <br />residential streets. <br /> <br />(c) That the use of the proposed site for petroleum storage <br />will not endanger the public health or safety. <br /> <br />(2) If the property adjoins a non-residential district, the <br />following requirements' shall be met: <br /> <br />(a) The storage facility must be located at least 50 feet <br />from the exterior property line. <br /> <br />(b) Vehicular access to the site will be provided from <br />major thoroughfares and will not require the use of minor <br />residential streets. <br /> <br />(c) That the use of the proposed site for petroleum <br />storage will not endanger the public health or safety. <br /> <br />(3) If petroleum storage tanks are located in a commercial zone, <br />then the maximum volume of storage permitted-shall be 100,000 <br />gallons. <br /> <br />(4) If petroleum storage tanks are located in the I-1 zone, <br />then the maximum volume of storage permitted shall be 500,000 <br />gallons. <br /> <br /> There was no one present to speak either for or against the proposed <br />zoning text amendment. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved to return the proposed text <br />amendment to the Planning Board for approval with 'Section B(1)(a) under <br />Conditional Uses modified from 120 feet to 200 feet from the exterior <br />property line bordering a residential district. <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board moved to go into Executive. Session to discuss <br />land acquisition. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Executive Session was terminated. <br /> Chairman Lentz stated that the Board had discussed legal problems and <br />possible.acquisition of. property during the Executive .Session. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board moved to authorize the County Attorney to <br />consummate the purchase of the agreed upon property at the agreed upon price <br />and to initiate any appropriate condemnation proceedings for the Water and <br />Sewer District change orders. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved that the'money come from the <br />Contingency Fund for the planned purchase of property if the County <br />Attorney gets the matter worked out. <br /> There being no further business to come before the Board, the meeting <br />adjourned at 8:50 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
