299 <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS LEASE, made and entered into this the 1st day of October, <br />1985, by and between the Board of County Commissioners of Cabarrus <br />County, North Carolina, a body corporate and politic, hereinafter called <br />lessor, party of the first part, and Historic Cabarrus, Inc., a non- <br />profit corporation organized and existing under the laws of the State <br />of North Carolina having its principal office in the City of Concord, <br />Cabarrus County, North Carolina, hereinafter called lessee, party of the <br />second part; <br /> <br /> W I T N E S S E T H : - that <br /> <br /> WHEREAS, Cabarrus County has determined' that the property hereinafter <br />described, known as the Old Cabarrus County Courthouse, will not be needed <br />by the County for the term of this lease and the renewal term; and that <br />it is in the best interest of Cabarrus County to enter into this Lease <br />Agreement. <br /> NOW, THEREFORE, IN CONSIDERATION OF THE PREMISES AND OF THE AGREEMENTS <br />HEREINAFTER SET OUT TO BE DONE AND PERFORMED BY THE LESSEE, the Lessor does <br />hereby demise and lease unto the Lessee the following described property: <br /> <br /> Lying and being in Ward No. 3 of the City of Concord, <br /> North Carolina, on the east side of South Union Street and <br /> on the south side of Means Avenue and being the lot upon <br /> which the old Cabarrus County Courthouse is located and <br /> described as follows: <br /> <br /> BEGINNING at a point in the southeast intersect£on of <br /> South Union Street and Means Avenue and running thence with <br /> Means Avenue in an easterly direction to a point; thence in <br /> a southerly direction parallel with and 40 feet from the rear <br /> wall of the old Cabarrus County Courthouse to a point; thence <br /> in a westerly direction along a line midway between the south <br /> wall of the old Cabarrus County Courthouse and the edge of <br /> the bottom step on the north side of the new Cabarrus County <br /> Courthouse to a point in the east edge of South Union Street; <br /> thence with South Union Street in a northerly direction to the <br /> BEGINNING. <br /> <br /> To have and to hold said lands and premises, together with all <br />privileges and appurtenances thereunto belonging to it, the party of the <br />second part, its successors and assigns for the term and upon the condi- <br />tions hereinafter set forth: <br /> 1. That this Lease shall commence as of the date hereof and shall <br />exist and continue to and including the 30th day of September, 1989; <br />provided, however, that the lessee may at its option and for the uses and <br />purposes aforesaid, extend the term of this Lease for an additional period <br />of four (4) years by notifying the lessor in writing at least ninety (90) <br />days prior to the date of the termination of this Lease. <br /> 2. That in lieu of the payment of rent, the lessee will accept the <br />old Cabarrus County Courthouse in its present condition and will: <br /> <br /> (a) secure it from damage by the elements and other <br /> hazards. <br /> (b) repair and paint the stucco and woodwork on the <br /> outside of the building and replace so much of the woodwork <br /> as may be damaged; and <br /> (c) repair and restore the interior of the building to <br /> a condition as much like its original condition as possible; <br /> provided, however, that central heating, air conditioning, <br /> electrical fixtures and appliances may be utilized in such <br /> ways as not to detract from the original appearance of the <br /> building and may make such additional improvements as shall <br /> contribute to the beauty of said building as it originally <br /> existed, all of which shall be done upon the advice and under <br /> the supervision of a competent architect and according to a <br /> general plan of restoration. <br /> (d) maintain said building and the grounds covered by <br /> this lease in a good state of repair. <br /> <br /> <br />
