30O <br /> <br /> 3. That the lessee will purchase and keep in force liability <br />insurance in such amounts and against such hazards as may be necessary <br />or desirable and will insure said building against fire and windstorm for <br />the use and benefit of the lessee or its contributors as their interests <br />appear. <br /> 4. That if the building upon the demised premises shall be damaged <br />by fire or other casualty, and such damages are of a minor nature, the <br />same shall be repaired by the lessee as quickly as is reasonably possible; <br />but if said building shall be damaged to such an extent as to render the <br />same unfit for uses or occupancy, this Lease shall terminate as of the <br />date of such damage. <br /> 5. That the lessee shall be responsible for the payment of all <br />bills for water, heating and electrical current, and the occupants of <br />the building shall be responsible for the payment of their own telephone <br />bills. <br /> 6. That the lessee shall have the right to sublet any parts of the <br />building to such organizations as it may desire subject to the terms of this <br />Lease; provided, however, that the lessee and its under tenants shall make <br />no unlawful or offensive use of the premises. Lessee hereby warrants that <br />it will not arbitrarily restrict the use of said premises and, subject to its <br />use of the building and the agreement it enters into with any sub-lessee, <br />will make the building available for bonafide public uses. <br /> 7. That if the lessee shall not be diligent in its solicitation of <br />funds and shall fail to pursue its work in the restoration of said building <br />in an orderly manner or shall fail to pay the costs of improvements as <br />agreed upon without just cause or excuse for a period of ninety (90) days <br />after written notice of such default by the lessor or shall violate any <br />other terms of this lease, the lessor shall have the right to its option to <br />declare this Lease cancelled. <br /> 8. That the funds for the preservation and restoration of the old <br />Cabarrus County Courthouse will necessarily be supplied by contributions <br />from individuals, firms, corporations, organizations, foundations and <br />other agencies; that the acquisition of such funds may not be constant but <br />will be affected by prior commitments of the respective contributors and <br />that a temporary suspension of work shall not be used as a reason for <br />cancellation of this Lease. <br /> 9. That the Lessor shall have no obligations or duties concerning <br />the maintenance, preservation or upkeep of the premises described in <br />this Lease. <br /> 10. That this Lease shall inure to the benefit of and be binding <br />upon the parties hereto and their respective successors and assigns. <br /> IN TESTIMONY WHEREOF, the Board of County Commissioners has caused <br />this instrument to be executed in its name by its Chairman and attested <br />by its Clerk and Historic Cabarrus, Inc., has caused this instrument <br />to be executed in its name by its President and attested by its <br />Secretary, all by order of its Board of Directors, the day and year first <br />above written. <br /> <br />ATTEST: <br />/s/ Frankie F.
