334 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at <br />7:00 P.M. on Thursday, November 7, 1985, at the County Courthouse in <br />Concord, North Carolina, for a public hearing regarding proposed Zoning <br />Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended bY the Planning <br />Board. Mr. Michael Byrd, member of the Cabarrus County Planning staff, <br />reviewed the location of the areas proposed for rezoning. Public input <br />was received by the Board prior to action regarding each of the proposed <br />amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 85-46. Homer L. Green, township 11, Zion Church Road East, <br />Map/PIN 5539-51-5781. Wishes to rezone from RMF-7 to C-3. Planning <br />Board voted to deny this request 5-0, felt this would be an encroach- <br />ment on the neighborhood. <br /> <br /> Mr. Homer Green stated he had requested the rezoning in order to <br />build a sheet metal shop on his property. However, he complained that he <br />was not informed until the Planning Board meeting that the rezoning would <br />negatively affect his mobile home park located on the property. Mr. <br />Green asked to withdraw the rezoning petition at this time and requested <br />that he be allowed to construct the shop on the property under a conditional <br />use permit. <br /> Mr. Michael Byrd advised the Board that a text amendment would be <br />necessary to allow construction of the shop as a conditional use in the <br />RMF-7 zones in the county. Mr. James F. Owens, Assistant Planning Director, <br />informed the Board that the Planning staff was in the process of redoing <br />the Schedule of Use Regulations in the Zoning Ordinance. <br /> The Board recognized the withdrawal of Petition 85-46 by Homer L. <br />Green. <br /> <br />(2) <br /> <br />Petition 85-47. J. Lee Pharr, township 11, North side of Highway 49, <br />Map/PIN 5528-28-0341. Wishes to rezone from ARR to I-1. Planning <br />Board voted 5-0 to approve this request, felt it would be an <br />appropriate use of this property. <br /> <br /> Mr. J. Lee Pharr requested to withdraw Petition 85-47 as he stated <br />the truck driver's school scheduled to lease the property decided to <br />locate elsewhere. He asked that the property remain zoned ARR. <br /> The Board recognized the withdrawal of Petition 85-47 by Mr. J. <br />Lee Pharr. <br /> <br />(3) <br /> <br />Petition 85-48. Douglas & Elizabeth Wayne, township 3, }~oresville <br />Road, Map/PIN 4674-21-3619. Wishes to rezone from ARR to I-2. This <br />(salvage yard) was an existing land use at the time of adoption of <br />the zoning ordinance, and the Planning Board felt it should have <br />been included in the I-X zoning category. <br /> <br />After discussion, and the recommendation that a signed affidavit from <br />the Planning Board stating this was an existing use at the time of <br />the zoning ordinance adoption be included, a motion was made to <br />include this in the existing I-X zones. The vote by the Board was <br />unanimous. <br /> <br />The property being zoned I-X would allow expansion of the business, <br />only if granted clearance by the Board of Adjustment. <br /> <br /> The Board of Commissioners received the following affidavit from <br />Mr. F. A.
