335 <br /> <br />and am aware of the property located on the Mooresville Road, owned <br />by Douglas and Elizabeth Wayne, which is currently zoned ARR. It <br />is my opinion that this property should have been zoned IX at the <br />time of the adoption of the Zoning Ordinance. <br /> <br /> /s/ F. A. Rankin <br /> F. A. Scarbrough, attorney representing the petitioners, <br />stated the petitioners had requested the I-2 zone as it was the only <br />zone in the county permitting a salvage yard. He stated the petitioners <br />would be in agreement to an I-X zone for this property. In conclusion, <br />Mr. Scarbrough presented the following petition signed by residents living <br />in the area. <br /> <br /> We, the undersigned neighbors of Douglas Wayne, support <br />his request to rezone his property (except for his house) from <br />ARR to I-2, in order for him to use his expanded shop. We <br />have been shown a list of the uses permitted under an I-2 zone. <br /> <br />There was no one present to speak against the requested rezoning. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board by resolution moved that <br />Map/PIN 4674-21-3619 with a zoning error originally be corrected to <br />read I-X. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Upright and <br />unanimously carried, the Board agreed to refund the rezoning application <br />fee to Mr. Douglas Wayne for the zoning error made on the part of the <br />Cabarrus County. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />(1) Petition 85-10. Amend Section 5.2-3, page 83, Fencing Around <br /> Swimming Pools, line 4: <br /> <br />Amend From: Four and one-half (4½) feet in height <br /> To: Four (4) feet in height <br /> <br />Add to end of section: <br /> This section shall also apply to day care centers having <br /> swimming pools with a depth of eighteen (18) inches or more. <br /> <br />Planning Board voted unanimously to approve this petition. <br /> <br /> There was no one present to speak either for or against the <br />Zoning Text amendment. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 85-10 to amend <br />Section 5.2-3, page 83, Fencing Around Swimming Pools, line 4, to read <br />as follows. <br /> Four (4) feet in height <br /> <br /> Add to end of section: <br /> This section shall also apply to day care centers having <br /> swimming pools with a depth of eighteen (18) inches or more. <br /> <br />(2) Petition 85-12.
