346 <br /> <br /> WHEREAS, the petitioners'are all adjoining land owners to Tulake <br />Drive, a road dedicated by virtue of plat and map of the Fingerlake <br />Subdivision, No. 2 Township, Cabarrus County, North Carolina, recorded <br />in the office of the Register of Deeds for Cabarrus County in Plat <br />Book 19, page 23; and <br /> <br /> WHEREAS, it is the intention of this Board to close said street <br />and conduct a public hearing on the question. <br /> <br />BE IT THEREFORE RESOLVED THAT: <br /> <br /> 1. A meeting and public hearing on the closing of Tulake Drive <br />as shown on the plat and map of Fingerlake Subdivision, No. 2 Township, <br />Cabarrus County, North Carolina and recorded in Plat Book 19, page 23 <br />shall be had before the Cabarrus County Commissioners at their regular <br />meeting on the 6th day of January, 1986. <br /> <br /> 2. Notice of the public hearing shall be published once a week <br />for four successive weeks in a paper of general circulation in the <br />County and notice of the meeting shall be prominently posted in at <br />least two places along the public road. <br /> <br />This 2nd day of December, 1985. <br /> <br />/s/ James W. Lentz <br /> <br />Chairman <br /> <br /> Mr. Charles D. McGinnis, County Manager, recommended that the <br />following rate as determined by the Data Processing Department be charged <br />to recover the actual cost for running lists of registered voters as <br />provided for in North Carolina General Statutes 163-66. <br /> <br />CHARGES FOR VOTER REGISTRATION LISTS <br /> <br /> 560.38 per hour charge for software <br /> 14.11 per hour charge for operator <br /> 102.45 per hour charge for computer <br /> 676.94per hour charge for lists (one hour minimum) <br /> x 3 hours for processing entire file <br />$2,030.82 charge for complete list / 40,000 voters = <br /> .05 per name (13,538 minimum) <br /> <br /> UPON MOTION of Commissioner Upright, seconded by Chairman Lentz and <br />unanimously carried, the Board moved to go from two cents (2¢) to five <br />cents (5¢) per name for the voter registration lists for the Board of <br />Elections with a specified minimum requirement of 13,538 name listings <br />before a list is run. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br />and unanimously carried, the Board adopted the provisions relating to the <br />extinguishment of ancient oil, gas and mineral claims as recommended by <br />the North Carolina General Assembly and authorized the publication of <br />a notice of the statute in the newspaper once a week for four consecutive <br />weeks prior to January 1, 1986. Under the provisions of General Statutes <br />1-42.9 as amended, the owner of the surface lands will gain fee simple <br />title to the subsurface rights, if the subsurface interests are not <br />preserved by being listed for ad valorem taxes and recorded with the county <br />register of deeds within two years of January 1, 1986. <br /> Mr. Walter C. Odell, III, County Engineer, reviewed the proposed <br />revisions to the Cabarrus County Water System Regulations. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following Cabarrus County <br />Water System Regulations effective December 2, 1985, with the Rate and <br />Fee Schedule to be effective January 1, 1986. <br /> <br /> <br />
