He stated that the Douglas Fir poles were straighter and <br /> had fewer knots than the Yellow Pine poles. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby <br /> and unanimously carried, the Board awarded the bid to Koppers Company, <br /> Inc, in the amount of $7,874.00 for the Douglas Fir poles because these <br /> poles are straighter and better quality than the Yellow Pine poles. <br /> The Board reviewed the notification from the North Carolina Department <br /> of Natural Resources and Community Development of the award of $16,000.00 <br /> in matching funds under the North Carolina Land Records Management Program. <br /> Mr. Thomas B. Robinson, Planning Director, reported that County funds <br /> had been budgeted and that the grant would be used for orthophotography <br /> and remapping of the county. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Upright <br /> and unanimously carried, the Board accepted the $16,000.00 Land Records <br /> Management Program grant award from the State of North Carolina. <br /> Mr. Ted D. Joyner, President of the Cabarrus County Firemens' <br /> Association, Inc., requested $1,900.00 for partial funding of a Hazardous <br /> Material Seminar to be held in February, 1986 for firemen, rescue personnel, <br /> law enforcement and industry related personnel from Cabarrus County. <br /> He stated the two-day course by Safety Systems, Inc., would cost $4,800.00 <br /> and the remainder of the funding would be provided through Rowan Technical <br /> College. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br /> and unanimously carried, the Board agreed to provide this service for <br /> citizens at a cost of $1,900.00 for the Hazardous Material Seminar and <br /> appropriated $1,900.00 from Contingency Fund to the Fire Marshal's budget <br /> to provide the County's share of the cost for the seminar. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Upright <br /> and unanimously carried, the Board moved to go into Executive Session <br /> to discuss pending litigation. <br /> By consent, the Board invited the named defendants in the lawsuit <br /> by Martin Marietta Company and the Planning Board to go into Executive <br /> Session with the Board of Commissioners. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Hamby <br /> and unanimously carried, the Executive Session was terminated. <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, reported that the <br /> Board had discussed a proposed Consent Judgment in the pending Martin Marietta <br /> litigation pursuant to a specific document negotiated by the parties. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Upright <br /> and unanimously carried, the Board moved to adopt the Consent Judgment <br /> as proposed in the Martin Marietta litigation and to authorize the <br /> Chairman to execute the document in the event the judgment is satisfactory <br /> to the body. <br /> Mr. Thomas M. Brooke, attorney representing Malohn K. Coplon, <br />· presented a petition signed by Walter and Linda Holder, Malohn K. and <br /> Patricia Coplon, and Greg and Amy Browne requesting that Tulake Drive be <br /> closed to the public at the intersection of Fingerlake Drive as shown <br /> on the map of Fingerlake Subdivision filed in Plat Book 19, page 23, <br /> Cabarrus County Register of Deeds Office. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br /> and unanimously carried, the Board adopted the following Resolution <br /> Declaring Intent to Close a Public Road and set a public hearing regarding <br /> this matter on January 6, 1986, at 10:00 A.M. <br /> <br />NORTH CAJtOLINA <br /> <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT <br /> TO CLOSE A PUBLIC ROAD <br /> <br /> BE IT HEREBY RESOLVED that a Petition was filed at the December 2, <br />1985 meeting of the Cabarrus County Commission requesting the closing <br />of public road or easement pursuant to N.C.G.S. 153A-241; and <br /> <br /> <br />
