355 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at <br />7:00 P.M. on Thursday, December 5, 1985, at the County Courthouse in <br />Concord, North Carolina, for a public hearing regarding proposed Zoning <br />Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the Cabarrus County Planning staff, <br />reviewed the location of the area proposed for rezoning. Public input <br />was received by the Board prior to action regarding the proposed amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(i) <br /> <br />Petition 85-49. Mr. James Whitley/Whitley Motor Company, township 11, <br />Highway 49, Map/PIN 5528-17-9195, 27-2753, 27-5920, 27-0115. Wishes <br />to rezone from I-X/R-40 to I-1. Planning Board voted 4-0 to approve, <br />with a 100 foot buffer strip abutting the Carriker property. <br /> <br />There was no one present to speak for or against the proposed rezoning. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 85-49 by Mr. James <br />Whitley/Whitley Motor Company to rezone property on Highway 49, Map/PIN <br />5528-17-9195, 27-2753, 27-5920, 27-0115, from I-X/R-40 to I-1 less the <br />100 feet adjoining the Carriker land. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(i) <br /> <br />Petition 85-13. Staff request. The Planning Board voted 4-0 to <br />approve this ECHO (Elderly Cottage Housing Opportunity) text <br />amendment as: <br /> <br />A-2 A-I ARR R-40 R-30 R-15 R-9 R-8 R-7.2 <br />C C C C C C C C C <br /> <br />Page 104 conditional uses, Section 9.7-8 reserved. <br /> <br />Add under Section 9.7-8 Housing ECHO (Elderly Cottage Housing <br />Opportunity), and specific language. <br /> <br />Mr. James F. Owens, Assistant Planning Director, reviewed the <br />proposed ECHO (Elderly Cottage Housing Opportunity) text amendment. <br /> There was no one present to speak either for or against the proposed <br />text amendment. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved that Petition 85-13 submitted <br />as a staff request as set out in the agenda for conditional uses be <br />approved by the County Commissioners with the addition to Section C 2(d) <br />that any monies received in excess of actual costs to the County be <br />returned to the owner.
