ZONING ATLAS AMENDMENTS

(1)

Petition 85-50. Myraden Pierce, Mr. & Mrs. Ben De Biase, Ms. Carol
F. East, township 2, Highway 49 West, Map/PIN 5518-94-5818, 93-3906,
5528-03-2406, 04-2575, 13-0246. Wishes to rezone from A-I to I-2.
Planning Board voted 5-0 to approve, with the portion North of
Highway 49 being rezoned to I-1 and the land South of Highway 49
being rezoned to I-2.

During discussion of the requested rezoning, it was noted that the
rezoning was requested to permit the relocation of Fabricated Products, Inc.,
from Charlotte to Cabarrus County.
No one spoke either for or against the rezoning.
UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne
and unanimously carried, the Board approved Petition 85-50 by Myraden
Pierce, Mr. and Mrs. Ben De Biase, and Ms. Carol F. East to rezone
property on Highway 49 West, Map/PIN 5518-94-5818, 93-3906, 5528-03-2406,
04-2575, 13-0246, with the portion North of Highway 49 being rezoned to
I-1 and the land South of Highway 49 being rezoned to I-2.

(2)

Petition 85-51. Ms. Mary Lee Abernathy, township 10, Map/PIN
part of 5535-00-9870. Wishes to rezone from ARR to I-1. The
Planning Board voted 5-0 to deny this request, feeling it was
inappropriate at this time.

Mr. William L. Mills, III, attorney representing H & R Mullis
Machine Shop which has a contract for the purchase of the property,
spoke in favor of the rezoning to permit the relocation of a precision
machine shop from Mecklenburg County to the site. He stated the shop
would be compatible with the surrounding property and presented a petition
signed by adjacent property owners who were in favor of the rezoning.
Mr. Mills further stated the property was unsuitable for residential
purposes as it was located adjacent to the County's water tank site.
In conclusion, Mr. Mills complained there were no transitional classifications
from commercial to industrial zones in the County's Zoning Ordinance.
Mr. George Long, resident who lives across the road from the property
requested for rezoning, spoke in support of the rezoning.
During review of the petition, Mr. Thomas B. Robinson, Planning
Director, pointed out that rezoning the property to I-l~would constitute
spot zoning.
A motion was made by Commissioner Barnhardt and seconded by Chairman
Lentz to approve Petition 85-51.
UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne
with Commissioners Hamby, Payne, and Upright and Chairman Lentz voting
for and Commissioner Barnhardt voting against, the Board tabled the
original motion made by Commissioner Barnhardt.
UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne
and unanimously carried, the Board instructed the Planning staff to
develop a line item relating to the size of machine tool manufacturing
shops and that the smaller machine tool manufacturing concerns be permitted
in A-I and ARR zones and other such zones as they consider appropriate.
