391 <br /> <br /> Mr. Michael Byrd presented copies of an article from The Charlotte <br />Observer citing problems with .the package treatment plant located in <br />the Mecklenburg County portion of the Steeplechase subdivision. <br /> There was no one present to speak either for or against the <br />rezoning request. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />with Commissioners Payne, Barnhardt, and Hamby and Chairman Lentz voting <br />for and Commissioner Upright voting against, the Board approved Petition <br />86-05 by Sparta Brook Homes, Inc., to rezone property in township 1, <br />Map/PIN 5505-84-4103, from ARR to R-30. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(1) Petition 86-01. Light Industry and Manufacturing Facilities - <br /> the Planning Board voted 5-0 to approve this amendment. <br /> <br /> Mr. Thomas B. Robinson, Planning Director, reviewed the proposed <br />amendment which would allow light industrial and manufacturing development <br />in the rural areas of the county. He pointed out that this amendment would <br />not satisfy the requested Petition 85-51 for the proposed location of <br />a precision machine shop on a site currently zoned ARR in the Midland area. <br />During discussion, members of the Board expressed concern regarding the <br />physical appearance requirements of the side setback areas and necessary <br />changes were made to the proposed amendment. <br /> Mr. William L. Mills, III, attorney, stated the proposed amendment would <br />provide a lot of relief needed in the agriculture zones although it would <br />not help the owners of H & R Mullis Machine Shop who wished to relocate to <br />a site in the Midland area. He explained that this business has the potential <br />for expansion beyond the 20,000 square feet maximum area lot coverage specified <br />by the amendment. <br /> No one spoke in opposition to the proposed amendment. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved the Zoning Text Amendment as <br />amended with the recommended changes regarding side setback area requirements. <br />The Zoning Text Amendment as approved was as follows. <br /> <br />Petition 86-01 <br /> <br />Purpose: To allow light industrial and manufacturing development in the <br /> rural areas of the county. <br /> <br />Section 3.2-4 <br /> <br />Add <br /> <br />Light Industry and Manufacturing <br /> <br />A-2 ARR <br />C C <br /> <br />Add <br /> <br />Section 9.7-8 Light Industry and Manufacturing Facilities: <br /> <br />A. Intent <br /> <br /> It is the intent of this section to allow for compatible mixed uses <br />of land in the ARR and A-2 Districts by providing a means by which small <br />light industries may be developed on a site under continuing unified control. <br />The use must be found to be compatible with existing land uses, and shall <br />not have a substantial adverse impact on the health, safety, and welfare <br />of nearby residents, property owners, and of the community as a whole. <br />The burden of proof of such compatibility shall rest with the applicant <br />and the second part of Section 9.2-1(C) shall not apply in the granting <br />of this conditional use. This lisht industrial and manufacturing conditional <br />use shall n~_apply and cannot be granted within the Ten-Year Growth <br />Transition Oy. erlay District of the county. <br /> <br />B. Additional Requirements <br /> <br />(1) Minimum lot Area. The minimum lot area for the conditional uses <br /> allowed in this section shall be two (2) acres. <br /> <br /> <br />
