394 <br /> <br />the county and the lack of a deeded or dedicated right-of-way for a number <br />of roads in the county. <br /> There was no one present to speak either for or against the proposed <br />amendment. <br /> UPON MOTION of Chairman Lentz and seconded by Commissioner Barnhardt <br />with Commissioners Barnhardt, Payne, and Hamby and Chairman Lentz voting <br />for and Commissioner Upright voting against, the Board adopted Petition <br />86-02 as presented. The approved amendment was as follows. <br /> <br />Page 21 <br /> <br />Add <br /> <br />3.3-3 <br /> <br />Application of Base Setback Line <br /> <br /> On thoroughfare streets designated on the Cabarrus County or the <br />Kanlacon Thoroughfare Plan(s) a base setback line shall apply in addition <br />to the required setback requirements contained in the following Schedule <br />of Development Standards. The base setback line is defined to be the line <br />dividing the public right-of-way currently existing or designated in the <br />County Thoroughfare Plan. Non thoroughfare streets are not subject to <br />this provision. <br /> <br />Section 16 Definitions <br /> <br />Amend to read: <br /> <br />Base Setback Line: The base setback line is the line dividing the public <br />right-of-way currently existing or designated in the North Carolina <br />Department of Transportation Thoroughfare Plan for Cabarrus County. <br />This provision shall not apply to non thoroughfare streets. <br /> <br /> The substitute motion by Commissioner Payne and seconded by Commissioner <br />Upright for the Planning Board to put forth some more thought since the <br />problems have been brought up and bring hack recommendations as soon as <br />possible failed with Commissioners Hamby and Upright voting for and <br />Chairman Lentz and Commissioners Payne and Barnhardt voting against. <br /> <br />(3) Petition 86-03. Motion to Amend First Paragraph - the Planning <br /> Board voted 3-2 to approve this amendment. <br /> <br />Page 116 <br /> <br />Section 10 Amendments and Changes <br /> <br />Amendment to Section 10.1 Motion to Amend First Paragraph <br /> <br /> The Cabarrus County Board of Commissioners may upon its own motion, <br />or upon recommendation of the Planning Board or Planning Staff, or upon <br />application by a property owner or his agent, after public hearing and <br />notice, amend the regulations herein established and the maps which are <br />part of this ordinance. Any application for an amendment must be signed <br />by the applicant, who shall indicate the capacity in which he files the <br />application. In the event the party filing the application is someone <br />filing the same on behalf of another, such party shall attach his authority <br />to execute said application. <br /> <br />(4) <br /> <br />Petition 86-03 A.
