393 <br /> <br />c. Performance Standards <br /> <br /> The Board of Adjustment must find that the following performance <br />standards must also be met before a conditional use permit can be issued. <br /> <br />(1) Noise. Objectionable noise shall be muffled or eliminated so <br /> as not to become a nuisance to adjacent uses. <br /> <br />(2) <br /> <br />Smoke Emission. Every use shall be so operated as to prevent <br />the emission of smoke, dust, and dirt, etc., from any source <br />whatsoever, to standards notgreater than permitted by the North <br />Carolina Department of Natural Resources and Community <br />Development whose standards of air pollution for industrial <br />uses are hereby made by reference, a part of this ordinance. <br />The Board of Adjustment must receive a letter of recommendation <br />from the Department of Natural Resources and Community Development <br />Division of Air Quality before a conditional use permit can be <br />granted. <br /> <br />(3) <br /> <br />Dust and Dirt. Every use shall be so operated as to prevent the <br />emission in the air of dust or other solid matter which may cause <br />damage to property, discomfort to persons or animals beyond the <br />lot line of the property on which the use is located. <br /> <br />(4) <br /> <br />Industrial Sewage and Waste. Every use shall be so operated to <br />prevent the discharge into any waterway, lake, or the ground, <br />any waste which will be dangerous or a nuisance to persons or <br />animals, or which will damage plants or crops, or any public <br />water supply at or beyond the lot lines of the property on which <br />the use is located. The Board of Adjustment must receive a <br />letter of approval (from the Department of Natural Resources and <br />Community Development Division of Water Quality Control) as to <br />the method of treating and/or disposing of any industrial <br />wastewater. The Cabarrus County Health Department must approve <br />non-industrial wastewater treatment facilities up to three <br />thousand (3,000) gallons per day. <br /> <br />(5) <br /> <br />Odors. Every use shall be so operated as to prevent the emissions <br />of objectionable or offensive odors in such concentrations as to <br />be readily perceptible at any point at or beyond the lot line <br />of the property on which the use is located. <br /> <br />(6) <br /> <br />Glare. Every use shall be so operated as to prevent glare of <br />such intensity as to be readily perceptible from a residential <br />district. <br /> <br />(7) <br /> <br />Traffic Congestion. Each use shall be developed to prevent <br />traffic congestion and noise generated by vehicles related to <br />its operation. <br /> <br />(8) <br /> <br />Buffering. Each use shall provide a buffer strip as required <br />by Section 5.10 of this ordinance where its property line <br />abuts the property line of residential uses. <br /> <br />D. Additional Conditions <br /> <br /> The Board of Adjustment may make any additional conditions and <br />appropriate safeguards that it deems necessary in order to assure that <br />the spirit and intent of the ARR and A-2 Districts are not impaired. <br />Furthermore, the Board of Adjustment may make any of the conditions set <br />forth in this section more stringent in order to protect the health, <br />safety and welfare of nearby property owners and the citizens of Cabarrus <br />County, and to insure that the intent of this section is upheld. <br /> <br />(2) Petition 86-02. Application of Base Setback Line - the Planning <br /> Board voted 5-0 to approve this amendment. <br /> <br /> During review of the proposed amendment, the Board discussed the <br />problems relating to the varying right-of-way widths for roads throughout <br /> <br /> <br />
