Hartsell, Jr., County Attorney, presented recom- <br />mendations for technical changes to the Fire Protection Resolution and <br />Contract to Provide Tax District Fire Service as directed by the Board <br />on March 17, 1986. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner <br />Barnhardt with Commissioners Hamby, Barnhardt, and Upright and Chairman <br />Lentz voting for and Commissioner Payne voting against, the Board on <br />first reading amended the third paragraph of Section 5(a) of the Fire <br />Protection Resolution to read as follows: <br /> <br />No absentee or proxy votes will be allowed, nor shall such election <br />be conducted by mail. <br /> <br /> The second reading of this amendment was scheduled for the regular <br />meeting of the Board on April 7, 1986. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved the technical changes to the <br />Protection Resolution and Contract to Provide Tax District Fire Service <br />as recommended by the County Attorney. These amendments were as <br />follows: <br /> <br />FIRE PROTECTION RESOLUTION <br /> <br />1) <br /> <br />Change last sentence of Section 4 to read: If the <br />deficiencies have not been corrected, the fire marshal shall <br />notify the Board of County Commissioners and the monthly <br />payments may cease until such time as the department shall <br />meet the minimum standards of the resolution. <br /> <br />Change the first sentence of Section 5(b) to read: Each fire <br />department shall have a fire chief, an assistant chief, other <br />necessary officers and personnel with a minimum of nineteen <br />(19) fire fighters who are "eligible firemen" in accordance <br />with G.S. 118-38. <br /> <br />3) <br /> <br />5) <br /> <br />Change the first sentence in Section 5(e) to read: Each <br />department shall carry liability insurance on its personnel <br />and equipment in the indemnity amount of at least , <br />and further holding the county harmless from any <br />responsibility for damages, claims or expenses resulting from <br />the activities of its fire fighters or from the operation of <br />its equipment. <br /> <br />Change the last sentence of Section 5(h) to read: Each fire <br />department shall respond to the call of the fire marshal who <br />shall assist the officer in charge in coordinating the <br />activities of responding fire departments at the fire <br />emergency. <br /> <br />Change the second sentence of Section 5(m) to read: This <br />system may include a siren capable of being activated by the <br />Cabarrus County Fire Dispatch Center and should include radio <br />receivers for individual members or a telephone call system to <br />be used by members. <br /> <br />CONTRACT TO PROVIDE TAX DISTRICT FIRE SERVICE <br /> <br />l) <br /> <br />Change Section 1 to read: The County of Cabarrus agrees to <br />annually levy and collect upon all taxable property lying <br />within the boundaries of the Rural Fire Protection <br />Tax District an ad valorem property tax equal to __ cents <br />per one hundred dollars ($100.00) valuation, and after <br />deduction of the County's administrative charge for collection <br />of such taxes, to pay the same to the Fire <br />Department Inc. <br /> <br /> <br />
