494 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the County <br />Courthouse in Concord, North Carolina, on July 10, 1986, for a public <br />hearing regarding proposed Zoning Atlas amendments and the naming of an <br />unnamed road. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the County Planning staff, reviewed the <br />location of the areas proposed for rezoning and the location of the unnamed <br />road. Public input was received regarding the proposed amendments prior to <br />action by the Board of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(i) <br /> <br />Petition 86-15. Jack and Fannie Mae Parrish, off Poplar Tent Road, <br />township 2, Map/PIN 5610(01)-19-3089. Wishes to rezone from R-15 to <br />C-1. The Board voted 4-0 to approve this petition. <br /> <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, reviewed the pending <br />court action initiated by Mr. F. E. Isenhour, Zoning Administrator, against <br />Ronald G. Overcash and Jack and Fannie Mae Parrish as a result of violations <br />of the County's zoning requirements. He explained that Mr~ Isenhour had <br />issued a cease work order because the building had been expanded in <br />violation of the Zoning Ordinance and without the proper permits. Mr. <br />Hartsell further stated that Mr. Isenhour had filed the lawsuit which is now <br />pending when he obtained no results from the cease work order. <br /> Mr. Robert Irvin, attorney representing Mr. and Mrs. Jack Parrish, <br />requested the rezoning of the property. He stated that Mr. and Mrs. Parrish <br />had rented the store to Ronald G. Overcash who had remodeled the building <br />without their consent. Mr. Irvin further stated that his clients knew <br />nothing about the violations to the Zoning Ordinance and the stop work order <br />until the civil summons for the lawsuit was issued. He also read a letter <br />from Ray and Betty Morton, adjoining property owners, who stated the store <br />caused no problems for them. <br /> Mr. F. A. Rankin, Planning Board Chairman, reported that the pending <br />litigation regarding this property was not brought before the Planning Board <br />at the time Petition 86-15 was considered by them. <br /> Motion was made by Commissioner Payne and seconded by Commissioner <br />Upright to deny Petition 86-15. <br /> UPON SUBSTITUTE MOTION of Commissioner Hamby, seconded by Commissioner <br />Barnhardt with Commissioners Hamby and Barnhardt and Chairman Lentz voting <br />for and Commissioners Payne and Upright voting against, the Board tabled <br />consideration of Petition 86-15 until at least the meeting on August 7, <br />1986, and asked that Mr. F. E. Isenhour and Mr. Ronald G. Overcash explain <br />the situation to the Board. <br /> <br />(2) <br /> <br />Petition 86-17. Billy Jack Little, off Morehead Road, township 2, <br />Map/PIN 4598-56-3997. Wishes to rezone from C-3 and RMF-7 to C-3/RDO. <br />The Board voted 4-0 to approve this petition. <br /> <br /> There was no one present to speak either for or against the rezoning <br />petition. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Upright <br />and unanimously carried, the Board approved Petition 86-17 by Billy Jack <br />Little to rezone property off Morehead Road, Map/PIN 4598-56-3997, from C-3 <br />and RMF-7 to C-3/RDO. <br /> <br />ROAD NAME CHANGE <br /> <br /> Chairman Lentz opened the public hearing for the naming of an unnamed <br />road to Dileen Drive. There was no one present to speak either for or <br />against this road name. <br /> Board members expressed concern that there was no identifying <br />information for the unnamed road other than the fact that it was located off <br />Zion Church Road. It was determined that unnamed roads should be given an <br />in-house number by the Planning Department for identification purposes. The <br />unnamed road under consideration was given the number FY 86-87 01. <br /> <br /> <br />
