569 <br /> <br />service, and Rescue Squad operates a volunteer rescue organization which <br />provides ambulance and rescue service in addition to and as a supplement for <br />the regular ambulance service of County; and <br /> <br /> WHEREAS, County is authorized to make contributions to Rescue Squad <br />under the provision of G. S. 153A-445, and to operate an ambulance service <br />under the provisions of G. S. 153A-250; and <br /> <br /> WHEREAS, County and Rescue Squad desire to enter into a contract whereby <br />Rescue Squad will provide ambulance and rescue services in Cabarrus County in <br />addition to the regular ambulance service of County; and <br /> <br /> WHEREAS, Rescue Squad desires to secure the continued financial support <br />of County for a portion of its costs incurred in providing rescue and <br />ambulance services, and in the interests and welfare of its citizens, County <br />desires to provide financial support for a portion of the costs incurred by <br />Rescue Squad in its provision of ambulance and rescue services; and <br /> <br /> WHEREAS, County has appropriated the sum of Fifteen Thousand Dollars <br />($15,000.00) for this purpose for the period July 1, 1986 - June 30, 1987. <br /> <br /> NOW, THEREFORE, in consideration of the premises, County and Rescue <br />Squad do mutually agree to the following terms and conditions: <br /> <br /> 1. This contract shall begin July 1, 1986, and shall exist and <br />continue through June 30, 1987. <br /> <br /> 2. Rescue Squad shall provide voluntary rescue and ambulance service <br />in addition to the ambulance service provided by the Cabarrus County <br />Ambulance Service when dispatched by the Cabarrus County Communications <br />Center and/or the Cabarrus County Ambulance Service. Rescue Squad further <br />agrees that response for backup for the Cabarrus County Ambulance Service <br />shall be assumed by providing a monthly twenty-four hour per day standby <br />roster. <br /> <br /> 3. Rescue Squad shall provide mutual aid to other rescue squads and/or <br />fire departments in and for Cabarrus County as required. <br /> <br /> 4. County shall allocate and pay to Rescue Squad twelve (12) monthly <br />payments of One Thousand Two Hundred Fifty Dollars ($1,250.00) each, for a <br />total of Fifteen Thousand Dollars ($15,000.00), with each monthly payment to <br />be made on or about the last day of each month, commencing with July, 1986. <br /> <br /> 5. Rescue Squad shall use the funds paid to it by County for rescue <br />and ambulance service work. At the end of its fiscal year, Rescue Squad <br />shall undergo an audit of its operations conducted by a certified public <br />accountant, and shall submit a copy of the report of this audit to County <br />within ninety (90) days of the conclusion of its established fiscal year. In <br />addition, for County's 1987-88 fiscal year and for each succeeding fiscal <br />year of County for which Rescue Squad seeks a continuing appropriation from <br />County, by no later than March 15, Rescue Squad shall submit to County its <br />proposed budget for County's next ensuing fiscal year. <br /> <br /> 6. Rescue Squad agrees to hold County harmless from any and all <br />liability, damages or claims, including attorney's fees, that might be <br />asserted or suffered by County as a result of any act or omission of any of <br />Rescue Squad's officers, employees, agents or representatives arising out of <br />services performed pursuant to this contract. <br /> <br /> 7. This Contract may be terminated by either party upon thirty (30) <br />days' prior written notice to the other party, and may be renewed and <br />continued in full force and effect for each successive fiscal year in which <br />County makes an appropriation to Rescue Squad in its annual budget. Failure <br />of County to make an appropriation to Rescue Squad in its annual budget shall <br />be evidence that this Contract has not been renewed. <br /> <br /> IN TESTIMONY WHEREOF, the parties have caused this agreement to be duly <br />executed by their authorized officers pursuant to resolutions adopted in <br />accordance with law. <br /> <br /> <br />
