573 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the County <br />Courthouse in Concord, North Carolina, on Thursday, November 6, 1986, for a <br />public hearing on proposed Zoning Atlas and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Chairman Lentz introduced discussion of the $35,000.00 State grant to the <br />Piedmont Farmers Market and the return of the check by the County to the State <br />Budget Office with the request that the check be made payable to the Piedmont <br />Farmers Market, Inc. He stated the State could not take any action to reissue <br />this check until February and this delay would present a problem for the <br />Farmers Market as the property owner from whom the organization is purchasing <br />land desires a substantial payment on the property prior to January 1, 1987. <br />Chairman Lentz proposed that the County request that the check be returned and <br />the County enter into an agreement with the Piedmont Farmers Market, Inc., for <br />the disbursement of the money. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Barnhardt and <br />unanimously carried, the Board moved that the County get in touch with the <br />State Budget Office and ask that the check for the Piedmont Farmers Market, <br />Inc., be sent back to the County and that at the time the check gets back to <br />the County an agreement will be drawn up between Cabarrus County and the <br />Piedmont Farmers Market, Inc., for the disbursement of the money. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, pre- <br />sented each of the proposed Zoning Atlas and Text amendments as recommended by <br />the Planning Board. Mr. Philip Kingsland, member of the County Planning <br />staff, reviewed the location of each of the areas proposed for rezoning. <br />Public input was received prior to action by the Board. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 86-20. Marvin Knight, off Highway 27, township 10, Map/PIN <br />5544(03)-68-1690. Wishes to rezone from ARR to I-1. The Planning Board <br />voted 5-0 to recommend denial. <br /> <br /> Mr. Avery Lambert, property owner and resident of the area, opposed the <br />rezoning, stating he did not want a business next door to him. <br /> Ms. Barbara Black, speaking on behalf of Mr. Jonnie Harrington who owns <br />property adjacent to the Knight property, opposed the rezoning. <br /> Other residents of the area speaking against the rezoning were Messrs. <br />Jimmy Snyder, Alfred Mercer, and Bert Edwards. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz and <br />unanimously carried, the Board denied Petition 86-20 by Marvin Knight to <br />rezone property off Highway 27 from ARR to I-1. <br /> <br />(2) <br /> <br />Petition 86-31. Staff Request, off Highway 73 East, township 5, 8, and <br />11. Wishes to rezone from C-5 to C-2 and ARR. The Planning Board voted <br />5-0 to recommend denial. <br /> <br />(3) <br /> <br />This item was removed from the agenda. <br /> <br />Petition 86-28. Bessie Almond, off Highway 73 East, township 5, Map/PIN <br />5640(07)-89-9616. Wishes to rezone from C-5 to C-4/PDO. The Planning <br />Board voted 5-0 to recommend denial. <br /> <br />Mr. Gary Turner, representing his aunt who owns property in the area, <br />opposed the rezoning and stated the desire for the area to remain residential. <br /> Mr. Mike Martin spoke in support of the rezoning to allow himself and his <br />partners, Wayne and Melody Eudy, to open a used car lot on the property. <br /> Ms. Ann Wensil, owner of property in the area, spoke in support of the <br />rezoning. <br /> Ms. Mary Ann Middleton, resident of the Sleepy Hollow community, spoke in <br />opposition to the rezoning and operation of a used car lot on the property. <br /> Motion was made by Commissioner Barnhardt and seconded by Commissioner <br />Upright to approve Petition 86-28 to rezone Map/PIN 5640(07)-89-9616 from C-5 <br />to C-4/PDO to allow for a car lot only and if the land ceases to be used as a <br />used car lot, the zoning reverts back to the original C-5 zoning. No vote was <br />taken on this motion. <br /> <br /> <br />
