574 <br /> <br /> It was noted that the Board had not received a written report regarding <br />the requested Planned Development Overlay District from the Planning Director <br />as required by the Cabarrus County Zoning Ordinance. <br /> UPON SUBSTITUTE MOTION of Commissioner Payne, seconded by Commissioner <br />Hamby with Commissioners Payne and Hamby and Chairman Lentz voting for and <br />Commissioners Upright and Barnhardt voting against, the Board tabled Petition <br />86-28 to rezone property off Highway 73 East, Map/PIN 5640(07)-89-9616, until <br />the meeting on December 15, 1986. <br /> <br />(4) <br /> <br />Petition 86-29. James Montgomery, off Odell School Road, township 3, <br />Map/PIN 4681-(07)-59-7113. Wishes to rezone from ARR to R-9. The <br />Planning Board voted 5-0 to recommend denial. <br /> <br /> R. S. and Lillian Benson, property owners in the community, spoke regard- <br />ing the poor condition of the property known as the Odell Teacherage and the <br />need for repairs to the facility. <br /> James and Catherine Montgomery requested the rezoning to permit them to <br />renovate the Odell Teacherage for use as a triplex. <br />There was no one present to speak in opposition to the rezoning request. <br />UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />with Commissioners Upright, Barnhardt, and Hamby voting for and Commissioner <br />Payne and Chairman Lentz voting against, the Board approved Petition 86-29 by <br />James Montgomery to rezone property off Odell School Road, Map/PIN <br />4681-(07)-59-7113 from ARR to R-9. <br /> <br />(5) <br /> <br />Petition 86-30. Ernestine Earnhardt, off Dalewood Avenue, township 4, <br />Map/PIN 5623(11)-67-7407. Wishes to rezone from R-40 to R-9. The <br />Planning Board voted 5-0 to recommend approval. <br /> <br /> Ms. Ernestine Earnhardt requested the rezoning to permit the construction <br />of duplex on the property. <br /> There was no one present to speak against the rezoning request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 86-30 by Ernestine <br />Earnhardt to rezone Map/PIN 5623(11)-67-7407 from R-40 to R-9. <br /> <br />(6) <br /> <br />Petition 86-32. Jay Lee Wallace, off Jackson Park Road, township 4, <br />Map/PIN 5614(20)-91-8959. Wishes to rezone from R-7.2 to C-2. The <br />Planning Board voted 3-2 to recommend approval. <br /> <br /> Mr. Philip Kingsland reported that the City of Kannapolis had recommended <br />denial of Petition 86-32 as the area off Jackson Park Road was slated to be <br />zoned O-I under the City's zoning regulations. <br /> Mr. H. L. Ruth, III, attorney representing Mr. Jay Lee Wallace, stated <br />the purpose of the rezoning request was to allow the new sign which had been <br />erected at Wallace Furniture Store to remain. He stated persons in the <br />Jackson Park area had asked that the City of Kannapolis give that area some <br />type of commercial zoning and proposed that the Board of Commissioners table <br />the rezoning request until the City of Kannapolis enacts its zoning <br />regulations. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt and <br />unanimously carried, the Board denied Petition 86-32 by Jay Lee Wallace to <br />rezone property off Jackson Park Road from R-7.2 to C-2. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />Petition 86-07. Add Section 16 Definition: <br />Mobile Home Subdivision: A subdivision regulated by the Cabarrus County <br />Subdivision Regulations containing or designed to contain one or more <br />Class I mobile homes. <br /> <br />Change Mobile Home Class I Definition: <br />Mobile Home Class I: Mobile homes which comply with United States <br />Housing and Urban Development code and Mobile Home Construction Standards <br />and which meet appearance criteria in Section 5.16, as certified by the <br />Zoning Official. The Planning Board voted 5-0 to recommend approval. <br /> <br /> There was no one present to speak either for or against the proposed text <br />amendment. <br /> <br /> <br />
