575 <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 86-07 as follows: <br /> <br />Add Section 16 Definition: <br />Mobile Home Subdivision: A subdivision regulated by the Cabarrus County <br />Subdivision Regulations containing or designed to contain one or more <br />Class I mobile homes. <br /> <br />Change Mobile Home Class I Definition: <br />Mobile Home Class I: Mobile homes which comply with United States <br />Housing and Urban Development code and Mobile Home Construction Standards <br />and which meet appearance criteria in Section 5.16, as certified by the <br />Zoning Official. <br /> <br />(2) Petition 86-08. Change Section 10.1, Paragraph two: <br /> <br />From: In the event .... Planning Board <br /> <br />To: <br /> <br />In the event the applicant is someone other than the owner of a <br />property sought to be rezoned, the application shall contain the <br />name and address of the owner and the Zoning Official shall mail <br />a notice of such rezoning application in accordance with G.S. <br />153A-343. The Planning Board voted 5-0 to recommend approval. <br /> <br /> There was no one present to speak either for or against the proposed text <br />amendment. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 86-08 to change Section 10.1, <br />Paragraph two as follows: <br /> <br />In the event the applicant is someone other than the owner of a property <br />sought to be rezoned, the application shall contain the name and address <br />of the owner and the Zoning Official shall mail a notice of such rezoning <br />application in accordance with G.S. 153A-343. <br /> <br />OTHER BUSINESS: <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne and <br />unanimously carried, the Board authorized Chairman Lentz to execute a lease <br />agreement with Carl Pressley and wife pursuant to the purchase contract for <br />property purchased from Mr. and Mrs. Pressley for the Coddle Creek Reservoir <br />project. The Residential Lease Agreement is as follows. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESIDENTIAL LEASE AGREEMENT <br /> <br /> THIS LEASE, executed the 30th day of October, 1986, between Cabarrus <br />County, a body politic and political subdivision of the State of North Carolina, <br />whose mailing address is Post Office Box 707, Concord, North Carolina <br />28026-0707, hereinafter called Landlord, and Carl E. Pressley and wife, <br />Dorothy C. Pressley, whose mailing address is 2145 Rankin Road, Concord, North <br />Carolina 28025, hereinafter called Tenant; <br /> <br />W I T N E S S E T H: -- <br /> <br /> That in consideration of the mutual covenants and agreements hereinafter <br />set forth, the Landlord leases to the Tenant and the Tenant takes and leases <br />from the Landlord the real property described in Exhibit A attached hereto and <br />incorporated herein by reference (sometimes referred to as the "Demised <br />Premises"). <br /> <br /> Tenant shall have and hold the Demised Premises subject to the following <br />covenants and conditions: <br /> <br /> 1. Term. The term of this lease shall commence on October 30, 1986, <br />and shall expired on October 31, 1987. <br /> <br /> <br />
