3 <br /> <br />to, the annual conference of the International Management Association, the <br />National and State Associations of Counties, and such other national, <br />regional, state and local governmental groups and committees thereof to <br />which MCGINNIS belongs, of which he is a member, or to which he renders <br />service; and <br /> <br /> (iii) the travel and subsistence expenses of MCGINNIS for <br />short courses, institutes and seminars that are necessary for his profes- <br />sional development and/or for the benefit of COUNTY. <br /> <br /> 10. ANNUAL REVIEW: At least annually, COUNTY shall review and evaluate <br />the performance of MCGINNIS in advance of the adoption of the annual operating <br />budget. COUNTY shall increase MCGINNIS' base salary and/or other benefits in <br />the amount and to the extent that the Board of Commissioners of COUNTY may <br />determine; provided, however, that such increases shall not be authorized in <br />any year in which a general freeze on salaries of COUNTY employees of COUNTY <br />has been established. <br /> 11. TERMINATION: Either party may terminate this Agreement at any time <br />upon giving 90 days written notice to the other of its intent to do so, and <br />this Agreement shall terminate 120 days from the date of the receipt of such <br />notice; provided, however, that if said 120-day period ends on a date other <br />than the last day of a month, this Agreement shall terminate as of the last day <br />of the month in which said 120th day occurred. This Agreement shall immediately <br />terminate upon the death of MCGINNIS, and COUNTY shall pay to the estate of <br />MCGINNIS the compensation otherwise payable to MCGINNIS through the end of the <br />month in which his death occurs. <br /> 12. BONDING. COUNTY shall bear the full cost of any fidelity or other <br />bond required of MCGINNIS as Manager under any law or ordinance. <br /> 13. NOTICES: Any notice required or desired to be given under this <br />Agreement shall be deemed given if in writing sent by Certified Mail to his <br />residence in the case of MCGINNIS, or to its principal office in the case of <br />the COUNTY. <br /> 14. ENTIRE AGREEMENT: This Agreement contains the entire understanding <br />and agreement of the parties and shall be binding upon and shall inure to the <br />benefit of the heirs at law and personal representatives of MCGINNIS. It may <br />be changed only by an agreement in writing signed by the parties. <br /> 15. ASSIGNMENT: This Agreement may not be assigned by either party. <br /> IN WITNESS WHEREOF, the COUNTY has caused this Agreement to be signed and <br />executed on its behalf by the Chairman of its Board of Commissioners and duly <br />attested by its Clerk, and MCGINNIS has signed and executed this Agreement, <br />this 5th day of January, 1987. <br /> <br />ATTEST: <br />/s/ Frankie F. Hartsell, Jr. <br /> <br />County Attorney <br /> <br /> The Board held the second reading of the Subdivision Ordinance Revision. <br />Mr. Fletcher L. Hartsell, Jr., County Attorney, asked that Item C.6 of Section <br />4.9 regarding the installation of street signs be deleted at this time. He <br />stated that Street Sign Installation Policy recently adopted by the County <br />would need to be incorporated into this provision and brought back to the Board <br />at a later date for consideration. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne with <br />Commissioners Payne, Hamby, and Melvin and Chairman Lentz voting for and <br />Commissioner Moss voting against, the Board approved on second reading the <br />"Revised" Subdivision Regulations for Cabarrus County, Approved by Cabarrus <br />County Planning Board, September 17, 1986, deleting Item C.6 of Section 4.9 <br />Roads with this space reserved for a future provision. <br /> <br /> <br />
