WHEREAS, MCGINNIS was employed as County Manager (hereinafter Manager) by <br />COUNTY on July 1, 1976, and since that date has served in such capacity in good <br />standing without an employment contract; and <br /> WHEREAS, it is the desire of the Board of Commissioners of Cabarrus County <br />(the "Board") to memorialize its understanding with MCGINNIS with regard to <br />certain benefits, conditions of employment and working conditions; and <br /> WHEREAS, in order to express its confidence in MCGINNIS, to recognize his <br />lengthy and effective administration, to provide inducement for MCGINNIS to <br />remain as Manager, and to insure the continued stability and sound operation of <br />county government, the Board of Commissioners of COUNTY desires to enter into <br />this Employment Agreement for the services of MCGINNIS as Manager of Cabarrus <br />County government; and <br /> WHEREAS, MCGINNIS desires to accept continued employment as Manager of <br />Cabarrus County government; <br /> NOW, THEREFORE, in consideration of the mutual covenants herein contained, <br />COUNTY, through the Board, and MCGINNIS agree as follows: <br /> 1. EMPLOYMENT AND DUTIES: COUNTY hereby employs MCGINNIS as Manager of <br />Cabarrus County government, and MCGINNIS agrees to perform the functions and <br />duties of Manager of Cabarrus County government as set forth in N.C.G.S. <br />153Ao82, together with such other legally permissible and proper duties and <br />functions as the Board shall assign from time to time. <br /> 2. TEEM: The term of this Agreement shall begin on July 1, 1986, and <br />shall terminate on July 1, 1990; provided, however, that at the expiration of <br />the original term of this Agreement or any extension thereof, this contract <br />shall automatically be extended for additional 4-year terms unless on or before <br />one hundred eighty (180) days prior to the expiration of the original term or <br />any extension thereof, either party gives notice to the other that this Agree- <br />ment shall terminate at the end of the then existing term. <br /> 3. COMPENSATION: For all services rendered by MCGINNIS, COUNTY shall <br />pay MCGINNIS an annual base salary of $52~066.00 per year, payable in at least <br />monthly installments at the same time that other COUNTY employees are paid. <br />Salary payments shall be subject to withholding and other applicable taxes. <br /> 4. HOURS OF WORK: It is recognized that MCGINNIS must devote sub- <br />stantial time outside normal office hours to the business of COUNTY; conse- <br />quently, as he shall deem appropriate, MCGINNIS is hereby authorized and <br />allowed compensatory time off during normal office hours equivalent to such <br />time devoted outside normal office hours. <br /> 5. WORKING FACILITIES: COUNTY shall provide MCGINNIS with such offices, <br />stenographic help, and other facilities and services as are suitable to his <br />position and appropriate for the performance of his duties. <br /> 6. VEHICLE ALLOWANCE: COUNTY recognizes that MCGINNIS' duties require <br />that he shall have and operate a vehicle while performing the duties required <br />pursuant to this Agreement. COUNTY shall pay MCGINNIS a vehicle allowance of <br />$300.00 per month for his use of his vehicle on COUNTY business within the <br />COUNTY, and further COUNTY shall pay MCGINNIS the regular mileage rate for <br />COUNTY employees for his use of his vehicle on COUNTY business outside Cabarrus <br />County, North Carolina. <br /> 7. EXPENSES: It is anticipated that MCGINNIS may incur reasonable <br />expenses in conducting the COUNTY's business. COUNTY agrees to reimburse <br />MCGINNIS for all such expenses upon MCGINNIS' periodic presentation of a <br />properly authenticated account of such expenditures. <br /> 8. FRINGE BENEFITS: COUNTY agrees to provide MCGINNIS all insurance <br />benefits, vacation benefits, sick leave and retirement benefits, including <br />deferred compensation, and all other benefits available to COUNTY employees in <br />accordance with the Cabarrus County Personnel Ordinance and the North Carolina <br />Local Government Retirement System. <br /> 9. PROFESSIONAL DEVELOPMENT: In order to provide for the continued <br />professional development of MCGINNIS and for the advancement and/or benefit of <br />COUNTY, COUNTY hereby agrees to budget for and to pay: <br /> <br /> (i) the professional dues and subscriptions of MCGINNIS necessary <br />for his continuation and full participation in such national, regional, <br />state and local associations and the organizations necessary and desirable <br />for his continued professional participation and growth; <br /> <br /> (ii) the travel and subsistence expenses of MCGINNIS for <br />professional and official travel, meetings and occasions adequate to <br />continue the professional, development of MCGINNIS and to pursue necessary <br />official and other functions of and for COUNTY, including, but not limited <br /> <br /> <br />
