or building development (whether immediate or future), and shall include all <br />divisions of land involving the dedication of a new street or change in exist- <br />ing streets; provided, however,that the following shall not be included within <br />this definition nor be subject to the regulations authorized by this Ordinance: <br /> <br />A. The combination or recombination of portions of previously platted lots <br />where the total number of lots is not increased and the resultant lots are <br />equal to or exceed the standards prescribed for new lots by this Ordinance; <br /> <br />B. The division of land into parcels greater than ten (10) acres where no <br />street right-of-way dedication is involved; <br /> <br />C. The public acquisition by purchase of strips of land for the widening or <br />opening of streets; <br /> <br />D. The division of a tract in single ownership whose entire area is no greater <br />than two (2) acres into not more than three (3) lots, where no street <br />right-of-way dedication is involved and where the resultant lots are equal to <br />or exceed the standards prescribed for new lots by this Ordinance. <br /> <br />E. Division of one lot from an original tract. The number of divisions out of <br />the original tract shall be limited to one every three (3) years. Should <br />additional division(s) be requested, subdivision procedures shall apply. <br /> <br />SECTION 2.2 OTHER DEFINITIONS <br /> <br />For purposes of this Ordinance, the following definitions shall apply: <br /> <br />A. ALLEY - a strip of land, owned publicly or privately, set aside primarily <br />for vehicular service access to the back or side of properties otherwise <br />abutting on a street. <br /> <br />B. BLOCK - a parcel of land which is bounded on all sides by public street or <br />roadway. <br /> <br />C. BUILDING SETBACK LINE - a line establishing minimum allowable distance <br />between the main wall of the building and the street or highway right-of-way <br />line when measured perpendicularly thereto. Covered porches, etc. whether <br />enclosed or not shall be considered as part of the main building and shall not <br />project into the required yard. <br /> <br />D. CLUSTER DEVELOPMENT - a subdivision in which building lots are grouped <br />together through a transfer of allowable density within the subdivided tract. <br />Cluster development permits more efficient development by creating lots with <br />grass land areas smaller than those required for conventional lot-by-lot <br />development, yet maintains application of normal lot density standards to the <br />subdivided tract as a whole by requiring that land area saved by lot size <br />reductions be reserved as permanent open or recreation space. <br /> <br />E. COUNTY COMMISSIONERS - the Board of Commissioners of Cabarrus County, North <br />Carolina. <br /> <br />F. DEDICATION - the giving of a parcel of land by the subdivider to a public <br />body for a specific purpose or for the general public use and the acceptance of <br />the land by the public body. <br /> <br />G. DOUBLE-FRONTAGE LOT - a continuous lot accessible from both of the streets <br />upon which it fronts. Corner lots are not included unless they front on three <br />roads. <br /> <br />H. LOT- a portion of a subdivision or any other parcel of land intended as a <br />unit for transfer of ownership or for development.or both. The word "lot" <br />includes parcel or tract. <br /> <br />I. LOT WIDTH - the distance between side lot lines measured at front yard <br />building line. <br /> <br />J. LOT DEPTH - the mean horizontal distance between front and rear lot lines. <br /> <br /> <br />
